Dunno about prosecution but give it a week or so, generally when they say “I will not resign” we’re down to the last few days.
Or until the new Missus Weiner has had enough and moves out, whichever comes first.

Call the Repub leadership and insist they DEMAND Weiner resign...the same exact way Dims have required that of REPUB reps, who've done less offense.
Article I, section 5. 2/3 vote of the House is all that is needed to expel him. No specific reason is required other than to convince the necessary number to vote “aye.” Only if Weiner interacted with underaged victims can he be prosecuted AFAIK.
