Tom Petty has told US presidential candidate Michele Bachmann to stop using one of his songs as part of her campaign, insisting he did not give the rightwing politician permission. Within 24 hours of the televised launch of Bachmann's 2012 campaign, Petty's lawyers reportedly pounced on the press-conference soundtrack, which used the song American Girl as exit music.
"Petty isn't pleased," reported NBC's Kelly O'Donnell, while Rolling Stone confirmed the singer's lawyers had sent the Minnesota congresswoman a cease and desist order. It's not even the first bump of Bachmann's campaign: during her announcement speech, the Tea Party supporter confused the birthplace of actor John Wayne with that of serial killer John Wayne Gacy.
Petty's problem appears to be with Bachmann's politics. In 2008, the singer allowed Democratic candidate Hillary Clinton to use American Girl for her unsuccessful presidential bid. But he was much less sympathetic in 2000, when Republican candidate George W Bush was discovered to be playing I Won't Back Down at his rallies. "This use has not been approved," Petty's representatives told the future president. "Any use made by you or your campaign creates, either intentionally or unintentionally, the impression that you and your campaign have been endorsed by Tom Petty, which is not true." Bush , er, backed down.
Politicians have got into lots of trouble using pop songs over the last few years. From Sarah Palin and Heart to Nicolas Sarkozy and MGMT, to David Cameron and Keane, politicians' rallying songs are proving a litigious nightmare. Perhaps they ought to look into using classical music.

He has an appropriate surname.
“...Tom Petty tells Michele Bachmann to stop using his music...”
Michele Bachmann tells Tom Petty to stop using our air.
Bachmann released a statement saying she is surprised that a legendary NASCAR driver would have a problem with her using the song, and she’s considering a boycott of STP fuel treatment. Ed Rollins could not be reached for comment.
Tom Petty now on my boycott list.
Music has already been removed from my ITunes.
that’s a real heartbreaker.
Maybe Obaammy could use “You Wreck Me” for his debt reduction and ecomomic plan entrance theme song.
TP doesn’t need the money. Not by a long shot.
Notice the digs into Michele by the writer... rightwing politician... the John Wayne thing again. Aholes....
I think Petty should authorize his “Free Falling” for use in the Obama campaign.
Gee, ya think?
I just got into a massive flame war on Willie’s Facebook page about this stupid loyalty to the Democrats. The legalize pot crowd is just dumb for believing that the Democrats are going to do anything different than the Republicans about legalizing marijuana. They are all stoner idiots.
This happens in every single election. Some Republican uses rock music as a theme and the singer gets his or her panties in a twist over it. Remember how Springstein whined about Reagan using “Born in the USA”? Or how that freak who made noises blew a gasket when Bush Senior used “Don’t Worry Be Happy” as his theme? Republicans need to realize that all they are doing by using the music is giving these has-beens a chance to be important and self-righeous again.
Petty is just being a “petty idiot”.Talented but a stupid lib
Does anyone know the law in these situations? I think Michele Bachmann should stop playing the washed up, lefty loser’s lousy music anyway, but can he force her to?
What rights does a song writer or recording “artist” have to restrict the use of music that he/she has sold recording of to the public?
What simple minded twit in the Bachmann campaign
decided it was OK to STEAL someone else's property ?
Tom Petty, whose vocals sound like a 60-year-old man imitating a pouting, petulant brat?
This is actually a blessing. Michele can do FAR better for campaign music.
MP has no RhINO Skin....
Ahh ole’ Tom wants ‘American Girl’ to only be remembered solely from ‘Silence of the Lambs’; a charming story of a transgendered, depraved, serial killer with another depraved, serial killer on the ‘inside’ (cellblock hell) whose aim was to break out and eat human liver.
Shoot, I can understand how linking the song with Michele Bachmann might really ruin that memory.
You’re making a huge ASSumption.
Do you know that Petty didn’t sell the rights to that song to some public domain entity?
From the article:
It's not even the first bump of Bachmann's campaign: during her announcement speech, the Tea Party supporter confused the birthplace of actor John Wayne with that of serial killer John Wayne Gacy.
I thought it was determined that Wayne's parents had lived in Waterloo, as did GAcy for a time - but that Gacy had been born in Chicago.......
If my recall is correct (often doubtful) than these "reporters" are the ones who are even more confused than they claim Bachmann to be.
Who is this Petty Tom, and what does he do? /s
Do you know that Petty didnt sell the rights to that song to some public domain entity?
Prove it; you twit !
More evidence that Michelle Bachmann is evil incarnate! Oh, the humanity!
...Tom Petty tells Michele Bachmann to stop using his music...
His last name explains it all. Michele, find another song and let this cr@p have his cr@ppy song. Who needs him or his music. Another whinny libertard.
Petty indeed. Washed up has-been, goofy looker with little vocal talent who’s best days were 3 decades ago.
Hey Tom! REPUBLICANS BUY CD’S TOO! Idiot
If he's not, he should be.
I’m disappointed that she was even using the whiny little snot’s music to start with. He sings like a 13 y.o.
Wonder if Ted Nugent has an appropriate song? I have a feeling Aerosmith may be open to their music being used by a republican, too. There are other options. Either way, the people running the campaign need to get it OK’d by the artist. Who’d want be backed by a song of an artist that obviously is against what you stand for?
So are you telling me that Tom is really a Dick? Who would have known. LOL
No. The copyright law allows anybody to play, as long as they pay the standard fee; which is usually "per performance." The term is "compulsory license."
-- What rights does a song writer or recording "artist" have to restrict the use of music that he/she has sold recording of to the public? --
In musical works, the artist is entitled to be compensated by those who cover or play the composition.
I got news for Mr. Petty. If Ms. Bachman is using a legally obtained copy of the song she has the right to play it in public all day long as long as she pays the associated fees for doing such. And Petty has no say in the matter whatsoever.
Then again, she launched her campain in the spirit of John Wayne Gacy so maybe it is an appropriate theme . . . . .
On a related note, what is it with Christian Conservative candidates (not to mention talk show hosts)and Rock and Roll music? Sex, Drugs and Rock and Roll are a good fit. Christianity, Conservatism and Rock and Roll are not, IMHO.
Actually This is the best point of the thread...
What made bachmann think that tom petty would not kick her in the backside given his history? Does she need another new chief of staff?
Aw hell, can’t a company just purchase a license and play it anyway?
I remember the same thing when the jerkoff beeotches in “Heart” were whining like stuck banshees over Palin’s use of “Barracuda”.
May as well just go ahead and dump your whole library, then.
The Star Spangled Banner or America softly played in background would be my selection. The heck with petty Tom Petty.
BTW Tom! Republicans PAY for the music they listen to?
Nope he can't do squat if she has a legal copy of the music and she pays the associated fees for public performance of the piece.
Its part of the Copyright Law and Little Tommy has no say whatsoever. He can ask but he can't legally force her to stop playing it.
This happens every election cycle. Celebs warn Republicans not to use their music, while granting authorization to the Dems. Nothing really new here.
However, R’s might just stop buying his music.
Thanks. That’s how I thought it worked, but with all these lefty “musicians” filing lawsuits against Republicans, I wondered if they really had some legal right to stop their songs from being played.
I could understand if the politician gives the impression that the “artist” endorses her or uses the copyrighted music in a campaign or fundraising video (especially if they sell said videos), but I would think if you publish and record music for public consumption, you have to deal with people you might not like playing your music.
“Wonder if Ted Nugent has an appropriate song?”
The recently released “I Still Believe” comes to mind. But maybe it would be more appropriate for Obama. Ted wouldn’t mind, I’m sure.
What simple minded twit in the Bachmann campaign
decided it was OK to STEAL someone else’s property ?
This is political grandstanding (by the lefty musician) with no legal basis.
And you have no clue about intellectual property law, although your confidence in your error is impressive.
