New attacks launched on Righthaven litigation campaign

The copyright infringement lawsuit campaign of Righthaven LLC of Las Vegas faces new attacks by three defendants.

Since March 2010, Righthaven has filed 274 federal lawsuits alleging online copyright infringement of material from the Las Vegas Review-Journal and the Denver Post.

Righthaven’s no-warning lawsuit campaign has been marred by three fair use losses since October, as well as rulings last month throwing out four lawsuits on a standing issue and a judge’s threat of sanctions against Righthaven over alleged misrepresentations.

Worth reading.

Still no case going after RightHaven on its claim that it can claim copyright protection on pictures it is using for profit when, in fact, neither RightHaven nor Stevens Media have the requisite releases from individuals or organizations depicted in those pictures.

I know, it's a trivial point, but until they started using the pictures as part of their "business model" they were claiming a right to publish them (without obtaining releases) because they were "news".

Once they turn them into commercial property, it's a whole 'nuther commercial business'.

Maybe they still believe they can do a “Bill Gates” and buy their way out of random lawsuits, banking that there will be no widespread furore.

I haven't been following this case closely, but I believe Righthaven has been on the losing end of all these court decisions mainly because it was demonstrated that they don't even actually own the copyrights on the material in question.

This basically means they are in the legal position of a plaintiff who files a lawsuit against someone for something that was allegedly done to the guy who lives across the street.
