Administration Asks Court To Halt Execution Of Mexican National In Texas

The Obama administration is taking the unusual step of asking the U.S. Supreme Court to stop Texas from executing a Mexican citizen who was convicted and sentenced to die for the rape and murder of a 16-year-old girl.

The administration is asking the court to delay the July 7 execution of Humberto Leal, 38, for as long as six months to give Congress time to consider legislation that would directly affect Leal's case.

I'm there now. All I see is the communists have taken over the entire Administration and has elected King Obama as dictator. There is a slight chance the House can or will do anything to slow down the empire change but more hope on 2012. King Obama army is huge since he has bought at least l/3 of the voters and the rest are so ignorant we might have a real hard time.

Notice NO WHERE in any reports does it say the scum told the police he was a mexican national.
So notice that today 0dumbo doesn’t want police to ask anyone if they are here legally
but in 1994 how would the police know he was not a citizen if he didn’t tell them?

I cannot imagine what the parents/family of the victim must be going through right now. They live through the horrible death of their child, the court case where they know what torment/torture/fear/agony she endured before taking her last breath and now the government trying to stop justice for being served for their girl. Based on what? Because he was illegal and couldn’t understand the language or what rights he had? He seemed to understand that smashing a huge block of concrete on a girl’s head would kill her. This is infuriating to me!

If I were in charge of the Texas prison system, I'd announce that we'd comply to the administration's request by releasing the POS into the general prison population.

Then, I'd arrange for the guards to take a break when he was out of his cell.

If this crap keeps up, Jeffrey Dahmer style executions are going to become a lot more common.

We used to have a saying in corporate America, "If it's not in writing, it didn't happen.".

I'm not a lawyer, but is there no standard form that people must sign in law that states that they have been "told" things, like reading their rights or contacting Consulates?

Is there no checklist to insure that nothing is missed along the line to allow these thugs to get out on a technicality 16 years later?

Is there anyone around from 16 years ago who could testify as to what the guy was told, and what he was not told. Then, you have the language barrier involved.

This is nothing but pandering to the hispanics by obama to shore up his ratings for election.

Now, he wants to wait for a law to be passed by Congress what would exonerate the perp? Is it a retroactive law from 16 years ago?

Will the technicality law bring the 16-year-old girl back to life.

This POS lived here since he was 2 years old thanks to his illegle parents. He can speak English just fine and doubtful he considered himself a Mexican national. We could always just send him back via the back ramp of a C130 at about 16k feet. How his native soil welcomes him back would be his problem.

I truly don’t know how parents cope with something like this. If it had been my child, I will confess honestly that I think I would have to be institutionalized. The knowledge of my child being raped, bitten, a stick shoved into her, and smashed in the head would be the end of me. Personally, I would volunteer to pull the lever, push the button... whatever is done to end it for this guy.

Good theory. I think this bunch and Mexico knew about the illegal gun running. That way Mexico could sue United States and Obama could use that towards gun sales here. Mexico gets money and this “bunch” could get stricter gun laws here. Any takers on that theory?

Interesting little note: as per some old Sup. Ct. precedent, treaties that are not self-executing do not bind the states until Congress enacts legislation to put the treaty into effect. See, e.g., Whitney v. Robertson, 124 U.S. 190, 194 (1888).

In this case, notwithstanding that the treaty in question (which I do not know the name of off the top of my head) apparently does provide that the nationals of signatories are to be provided with consular assistance, the treaty itself appears - from the reports on the need to enact legislation to review alleged violations of the treaty - to not be self-executing and thus not binding on the states until and unless Congress enacts legislation making it so.

In other words, the State of Texas appears to be at liberty to ignore the provisions of this treaty until Congress has enacted legislation saying otherwise.

That means, in essence, that Obuttocks is trying to bootstrap the binding effect of the treaty by, in essence, claiming that it ought to be binding on Texas because, if you just give Congress enough time, Congress will do what it needs to do to make the treaty binding on Texas.
