SOMERSET COUNTY Call it bullying or call it horseplay. Either way, a state appellate court panel says roughhousing with a sexual connotation by a pair of 14-year-old Somerset County boys was a crime that requires them to register as sex offenders for the rest of their lives.
In a decision handed down Monday, the three-judge panel acknowledged the severity of its decision, but said it was bound to uphold the law.
"We are keenly aware that our decision may have profound lifelong ramifications for these two boys as well as others similarly situated," Judge Jose Fuentes wrote.
One of the boys, whose case went to trial, said he had sat on the faces of a pair of 12-year-old schoolmates with his bare buttocks in November 2008 "cause I thought it was funny and I was trying to get my friends to laugh," he told a family court judge.
But an act is considered criminal sexual contact if it is done for sexual gratification or to degrade or humiliate the victim, and punishable by lifetime registration even for juveniles under Megans Law, which requires a person convicted of a sex crime against a child to notify police of changes of address or employment.

Planting your ass on somebody’s face is grounds for an ass kicking.
Reminds me of an article I read one time about a guy who was camping out in the middle of nowhere where he (thought) he was alone. Went back into the woods to take a whiz, and was promptly arrested by two cops hiding out trying to entrap homosexuals. Charged with indecent exposure, and has to register on a sex offender list for the rest of his life. For taking a whiz in the woods where he thought nobody was around.
We used to call them Atomic Sit-ups.
I wonder if this happened at the school...
Teabagging not really as funny as it sounds.
Eventually everyone will be on a sex offender registry somewhere so it won't quite the scarlet letter it once was.
“Did you really think we want those laws observed?” said Dr. Ferris. “We want them to be broken. You’d better get it straight that it’s not a bunch of boy scouts you’re up against... We’re after power and we mean it... There’s no way to rule innocent men. The only power any government has is the power to crack down on criminals.
Well, when there aren’t enough criminals one makes them. One declares so many things to be a crime that it becomes impossible for men to live without breaking laws. Who wants a nation of law-abiding citizens? What’s there in that for anyone? But just pass the kind of laws that can neither be observed nor enforced or objectively interpreted and you create a nation of law-breakers and then you cash in on guilt. Now that’s the system, Mr. Reardon, that’s the game, and once you understand it, you’ll be much easier to deal with.” (Atlas Shrugged 1957)
Don’t they know that’s why God gave us trees???
Sexual horseplay out of school - heavy-handed scarlet letter treatment by clueless judges
Sexual horseplay in school - approved public education curriculum
sorry - that comment meant for Titus Quinctius Cincinnatus

The statists use any opening to advance the state. So the people who demanded free love, special rights for homosexuals, the end to all pornography laws also are quite willing to coop conservatives with such registration laws all for the purpose of limiting the rights of more and more and more people.
I don’t know how many guys would have been kicked out of the Army for atomic sit-ups had this been considered that bad.
Ridiculous. All it does is dilute the effectiveness of the registries.
You can’t do this stuff anymore - unless you’re a teacher or a “sexual minority”.
Damn, we used to red eye kids all the time in soccer.
I've read of a teenage boy on the registry for mooning passing cars from the school bus. Others for skinny-dipping in a pond late at night.
Eventually these sex offender registries will be rendered worthless. They'll be so populated by mundane, minor offenders that those actual violent sexual predators will simply fall through the cracks, disappearing amongst the multitude of names.
Especially in California where the new law requires teaching sodomy to kids in kindergarten.
I agree. Simple crime. Simple punishment. No need for a registry or state involvement of any crime.
If the victim is unable to administer the ass kicking himself, he needs to think creatively for alternate justice. There are so many ways to punish a dickhead.
