He left open the possibility that they perform telephone intercept even in cases in which they have no formal authority to do so.
And everyone knows that has been going on for DECADES.

I don’t own a cell phone (what’s so d@mn important that you can’t wait till you get to your home or office phone?)
Or a Blackberry (I read email on my desktop).
Or a GPS/TomTom (I learned to read a map in the Army. I plan itineraries on MapQuest before traveling).
Of course, the gubmint knows who each and every one of us FReepers are, but what the heck?

This has been happening for years. The ability to track cell phones continues to used by law enforcement to catch guys, while they’re running from the police. Its how they go after terrorists and insurgents during combat op’s. Can it be used and abused by the government, but in some instances, there are quite a few bad guys in jail because of that technology.
