Family of Marine Killed in Arizona SWAT Raid Sues Pima County for $20 Million
Forbes.com ^ | August 17, 2011 | E. D. Kain

Posted on 08/18/2011 8:25:56 AM PDT by Immerito

Jose Guerena was killed by a Pima County SWAT team back in May. His wife, Vanessa, and 4-year-old son were in the home at the time but were fortunately unharmed when police fired dozens of bullets into the home. Guerena himself did not fire on police, but police reported he was holding a rifle when they broke the door down. Follow-up investigations have shown that Guerena was related to people likely involved in criminal activity, but Guerena himself appears to have been on the sidelines.

Now Vanessa Guerena is filing suit against Pima County to the tune of $20 million dollars.

Radley Balko follows up with a good summary of the case, the political fall-out, and the interesting detail that nobody has yet been arrested in the Pima investigations, including Jose Guerena’s brother, Alejandro, who appears to have been a much more likely suspect than Jose.

So despite the protest of many right here on FR there does actually seem to be a contingent (Given it is a small contingent, but it is clearly a growing one)of Jack Booted Thugs masquerading as dedicated LEO's in America.

I hope they win so big that they have to rename Pima County Guerena County.

The Sheriff shouldn’t be fired, he should be in prison.

These lawsuits against a county, when settled, are paid by the taxpayer. Why not by the perpetrators who caused the suit?

If they have the right lawyer:

TITLE 42 > CHAPTER 21 > SUBCHAPTER I > § 1983 Civil action for deprivation of rights

Every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or the District of Columbia, subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress, except that in any action brought against a judicial officer for an act or omission taken in such officer’s judicial capacity, injunctive relief shall not be granted unless a declaratory decree was violated or declaratory relief was unavailable. For the purposes of this section, any Act of Congress applicable exclusively to the District of Columbia shall be considered to be a statute of the District of Columbia.

“The Guerena family lawsuit likely faces an uphill battle.”

I am sure her lawyers are working on a contingency basis. The Counties Lawyers are being paid by taxpayers.

The family does face an uphill battle , but I believe the county have a hard time finding a jury that is not on the families side.

Every deputy who fired a shot in that battle should be out looking for a job. Adrenalin and gung ho Ninja tactics do not excuse shooting a man down like a dog.

It is not just the shooting in this case, that was certainly bad enough, but the fact that they waited over an hour (till he died) before they let the paramedics in to treat him.

That is what it makes it murder.

Agreed. Shooting a private citizen after breaking into his home is bad enough.

Letting the same private citizen bleed to death is unconscionable.

Had any non-officer done that, that individual would have been locked up long ago.

A civil suit should be much easier to prove than a criminal charge. There's no chance a judge will let the family collect 20 mil or anything close but 5 or 6 mil would help ease the financial worries.

Good!

We the jury find the sheriff’s office guilty of murder! We hereby award the plaintiff’s the $20 million dollars they requested, along with another $30 million dollars for punitive damages. And we the jury order via the citizen arrest procedures, we order that the AZ FBI, arrest of all member of this swat hit team, charging each for murder!
