NOM’s Brown laughed at on ‘Stossel Show’ for argument against marriage equality

On Thursday night's "Stossel Show," which airs on the Fox Business channel, Brian Brown was unable to convince host John Stossel or his libertarian guest (and nationally syndicated columnist) David Harsanyi that civil marriage for gays and lesbians harms, or even changes, marriage between heterosexual couples.

In fact, Harsanyi's suggestion that the marriage debate could be solved if the U.S. decided either to privatize all schools or all marriage contracts was treated as a more legitimate idea by Stossel and Stossel's audience....

"It is a mistake to allow government to define what marriage should be -- gay or not," Harsanyi said....

Brown argued. "The state should support what is true and good and beautiful...."

Stossel's live studio audience erupted in laughter at this comment, and Stossel replied: "I don't want the state deciding what's good and beautiful."...

Certainly, we do NOT want the state getting anywhere near deciding what is true and good and beautiful, as this nitwit Brown suggests. Perhaps "Brown" is a reference to the shirt color worn by folks who agree with him that the state ought to make this sort of decisions....

Perhaps brown is the color of your brain, as in shit for....

As I said above there are many reasons for states to encourage marriage in a welfare state, not the least of which is the current state of affairs in urban America where the state DISCOURAGED marriage with Great Society policies that destroyed the urban family and turned the USA into the Food Stamp States of America.

OK but never said it wasn't, the problem arrises when the government starts passing out goodies BECAUSE of Marriage. Better tax rates, Social Security Benefits etc...

Once that was in play then the "equal under the law" aspect is in play.

Except for the small problem that he's right. States have powers. Individuals have rights. "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people".

As I said to the other guy making a big deal about this, you are dealing in SEMANTICS. The federeal government is a government of limited and enumerated powers. The states hold the majority of the power in this country, or at least that's the way it is supposed to be. Don't pervert what I'm saying and try to infer from my mention of states' rights that I think states are superior to the people and that the people's rights are subservient to those of the state. It is the opposite, but that is OBVIOUS. The people exercise their wishes through their elected state legislatures and executive. The states have broad power to enact legislation.

The civil marriage contract has been part of the government of this country throughout its history.

Even the Congress has involved itself in the protection of this most fundamental and important of human institutions. Four states were only allowed into the Union if they would forever foreswear plural marriage, Oklahoma, Arizona, Utah and Idaho.

Are you claiming that we've been living all this time in a "theocracy," instead of a constitutional republic?

Do you support the right of states to determine for THEMSELVES what marriage laws they will have, or do you support the federal government coming in an mandating gay marriage on them in the name of liberty?

There's lots of issues that are best left to the states. This is not one of them. What if a couple got married in Massachusates and moved to Texas? Are they still married?

This is a bit of a different issue than setting local tax rates or speed limits, things that don't really matter once you cross a state boundary.

Outstanding post.

Libertarianism is a polite way of saying "anarchy". It is the old hippie mantra of "If it feels good, do it" made into a political ideology.

Way too broad of a brush. I am a small-l libertarian and I do not support the comments made by the original poster in this thread. The idea behind libertarianism is that you should be able to do what you want to do as long as it does not harm someone else. It is easy to apply this argument to smoking a joint in your own home. That harms no one. As Thomas Sowell said, homosexuals were on their strongest ground when they simply wanted the government out of their bedrooms. Now they seek to impose their sexual mores on the rest of society, and it is HARDLY a libertarian position to let them do this.

They can try. But the result will be exactly the same as for every other group of men who tried to do so throughout history.

Reality and right can be very harsh when you put yourself on the wrong side of it.

Um, what is your solution? I don't support the idea of forcing states to recognize homosexual marriages from other states through the Full Faith and Credit clause. States are not required to recognize gun permits from other states. Why should they be required to recognize homosexual marriage licenses? And if you say that we'll get a federal constitutional amendment to ban it nationwide, it would never pass. Maybe 10 years ago, but not now. The priority should be ensuring that the 44 states that don't currently allow homosexual marriage are not forced to allow it by the 6 that do. The states that don't allow homosexual marriage should not be forced to recognize it through a Supreme Court decision based on faulty constitutional principles.

Nobody is banned from marriage because of their sexual proclivities. Everybody can marry as long as you marry a member of the opposite sex that meets the age and familial requirements. That is the definition of equal under the law.

I agree with you right up to the point where you step off your property stoned.

I think its also a libertarian principle to carry one’s own water.

Legalizing marijuana is going to come with costs born by taxpayers, just as alcohol currently does.

They are different drugs, so I guess as long as we’re all honest about the specific costs associated with that one that we will all be on the hook for, then how bad could legalizing marijuana be in a country with food stamps, 99 weeks of unemployment, and socialized medicine?

Really. How bad could it be?

Back when slavery was still being practiced in this hemisphere one of the marks of the slave was their inability to enjoy the benefits of the civil marriage contract. The slaveholders resisted any notion of them having access to that, in the knowledge that many of the most important benefits of liberty are associated with it. Inheritance rights. Ownership of real property. Parental rights. And a whole lot more.

Those who won’t fiercely defend the institution of marriage in this country, at every level and on every front, are, whether they know it or not, helping in the drive to reduce this free people to the position of slaves.

No, it is the very nature of the male-female relationship that makes it uniquely suited for marriage. Our state laws regarding marriage should reflect the high value that society places on this bedrock institution, and elevating homosexual unions to the same status as marriages runs contrary to the Natural Law.

The only way to prevent these six states that currently allow homosexual marriage from solemnizing any more of them (and any more that ban it in the meantime) is to pass a federal constitutional amendment banning homosexual marriage nationwide. The odds of it succeeding are not very good, but it is the only constitutional way for the federal government to get involved in the marriage business. Time is really of the essence here, however, because once 13 states have legalized homosexual marriage, the battle is lost. You need three-quarters of the states to ratify it.

It was nothing of the sort.

Simply following the moral principles of the Bible doesn’t make us a “theocracy.”

The founders of this country were quite clear about the sort of government they were setting up: a republic.

And they asserted without any equivocation that you can’t rightly govern any country without the Bible.

Alexander Hamilton

Following his duel with Aaron Burr, in those final twenty four hours while life still remained in him, Hamilton called for two ministers, the Rev. J. M. Mason and the Rev. Benjamin Moore, to pray with him and administer Communion to him. Each of those two ministers reported what transpired. The Rev. Mason recounted:

[General Hamilton said] “I went to the field determined not to take his life.” He repeated his disavowal of all intention to hurt Mr. Burr; the anguish of his mind in recollecting what had passed; and his humble hope of forgiveness from his God. I recurred to the topic of the Divine compassion; the freedom of pardon in the Redeemer Jesus to perishing sinners. “That grace, my dear General, which brings salvation, is rich, rich” – “Yes,” interrupted he, “it is rich grace.” “And on that grace,” continued I, “a sinner has the highest encouragement to repose his confidence, because it is tendered to him upon the surest foundation; the Scrip¬ture testifying that we have redemption through the blood of Jesus, the forgiveness of sins according to the richness of His grace.” Here the General, letting go my hand, which he had held from the moment I sat down at his bed side, clasped his hands together, and, looking up towards Heaven, said, with emphasis, “I have a tender reliance on the mercy of the Al¬mighty, through the merits of the Lord Jesus Christ.” 35

The Rev. Benjamin Moore reported:

[I]mmediately after he was brought from [the field] . . . a mes¬sage was sent informing me of the sad event, accompanied by a request from General Hamilton that I would come to him for the purpose of administering the Holy Communion. I went. . . . I proceeded to converse with him on the subject of his receiving the Communion; and told him that with respect to the qualifications of those who wished to become partakers of that holy ordinance, my inquires could not be made in lan¬guage more expressive than that which was used by our [own] Church. – [I asked], “Do you sincerely repent of your sins past? Have you a lively faith in God’s mercy through Christ, with a thankful remembrance of the death of Christ? And are you disposed to live in love and charity with all men?” He lifted up his hands and said, “With the utmost sincerity of heart I can answer those questions in the affirmative – I have no ill will against Col. Burr. I met him with a fixed resolution to do him no harm – I forgive all that happened.” . . . The Communion was then administered, which he received with great devotion, and his heart afterwards appeared to be perfectly at rest. I saw him again this morning, when, with his last faltering words, he expressed a strong confidence in the mercy of God through the intercession of the Redeemer. I remained with him until 2 o’clock this afternoon, when death closed the awful scene – he expired without a struggle, and almost without a groan. By reflecting on this melancholy event, let the humble believer be encouraged ever to hold fast that precious faith which is the only source of true consolation in the last extremity of nature. [And l]et the infidel be persuaded to abandon his opposition to that Gospel which the strong, inquisitive, and comprehensive mind of a Hamilton embraced.36

One other consequence of Hamilton’s untimely death was that it permanently halted the forma¬tion of a religious society Hamilton had proposed. Hamilton suggested that it be named the Christian Constitutional Society, and listed two goals for its formation: first, the support of the Christian religion; and second, the support of the Constitution of the United States. This or¬ganization was to have numerous clubs throughout each state which would meet regularly and work to elect to office those who reflected the goals of the Christian Constitutional Society. 37

God commands all men everywhere to repent. He also commands them to believe on the Lord Jesus Christ, and has assured us that all who do repent and believe shall be saved… [G]od… has absolutely promised to bestow them on all these who are willing to accept them on the terms of the Gospel – that is, in a way of free grace through the atonement. “Ask and ye shall receive [John 16:24]. Whosoever will, let him come and take of the waters of life freely [Revelation 22:17]. Him that cometh unto me I will in no wise cast out” [John 6:37].108

No, Congress can simply legislate against it. They have all the legitimate authority to do so that they need, since the destruction of the most fundamental unit of self-government violates every single expressed purpose of our Constitution, most notably its crowning purpose: “to secure the Blessings of Liberty to Posterity.”

But if you want to pass an amendment for the purposes of clarification, fine. Do it.

The state should be out of the marriage license business anyway. As with so many of the contentious problems of today, it disappears when you remove the state’s imprimatur.

Remember, if the bad guys win this battle, next stop is outlawing divorce and remarriage (except your brothers widow). After all, ITS IN THE BIBLE.

I agree with you right up to the point where you step off your property stoned.

There's nothing thereotically wrong with stepping off your property stoned as long as you don't put the lives of others at risk. Driving while stoned should be punishable by at least a year in prison, the same as driving while drunk.

I think its also a libertarian principle to carry one’s own water.

It is, and if we eliminated the massive cost of the WOD, we'd stop the process of giving non-violent drug users criminal records for what in many cases is a medical addiction. We don't treat alcoholics as criminals. We shouldn't treat other drug users as criminals as long as they are non-violent. People who commit crimes while under the influence of drugs should be subject to enhanced penalties.

Legalizing marijuana is going to come with costs born by taxpayers, just as alcohol currently does.

They are different drugs, so I guess as long as we’re all honest about the specific costs associated with that one that we will all be on the hook for, then how bad could legalizing marijuana be in a country with food stamps, 99 weeks of unemployment, and socialized medicine?

Really. How bad could it be?

We arrest over 800,000 people for marijuana-related offenses per year. The vast majority of these arrests are for simple possession. Legalizing the substance would save a ton of money and would more than make up for any increased costs. The only downside of legalization is the possibility of additional addicts (although I've never seen any evidence that marijuana is physically addictive like alcohol can be). As Milton Friedman said, however, I'm willing to accept the possibility of additional addicts. What I'm not willing to accept is the idea that innocent people will be injured in drive-by shootings by drug cartels that only exist because of a black market created by our drug laws. And it's not just innocent Americans that are being killed (whether it's by cartels or by law enforcement in Special Forces-type raids). The War on some Drugs is also responsible for thousands of Mexican civilians that have been killed since 2006. The Mexican drug cartels exist to satisfy the incredible American demand for marijuana, among other drugs (but mostly marijuana). As Friedman went on to note, if you look at the War on Drugs from a purely economic point of view, the role of the government is to protect the drug cartel.

Marriage, be it monogamous or polygamous, is an ancient institution that predates the nation-state, to say nothing of the welfare state, by millennium. It arose as a solution for social tensions caused by inheritance concerns, availability of women, and the stable raising of children.

The reason this has evolved into a problem is that the state (which is far too deeply involved in our lives) has gotten far too deeply involved in the business of marriage. There's too much state-derived advantage in getting married to your average homosexual or 4 wived Imam to let it go.

The solution is to leave marriage to the churches (or mosques) or the institutions that invented them, and leave the state out of it. Cultures have generally respected marriage between them, but it's never really cost anyone money before to respect someone's marriage. It does now. If you so much as question it, there's probably some hate crime violation they'll slap you with. That's the problem. With marriage as a state concern, how the state wants you to think becomes a community, social, and very personal concern to every American.

This is the trap that people who favor the state's involvement have wrought. If you feel that the state should be in the marriage business, then you're basically playing a game against people who will keep changing the rules until they win.
