Federal judge won't temporarily halt rifle sale rules

WASHINGTON, Sept 1 (Reuters) - In a setback for gun dealers in four U.S. states bordering Mexico, a federal judge on Thursday refused to temporarily block new rules requiring them to report the sale of multiple semi-automatic rifles.

Judge Rosemary Collyer said the dealers, backed by the National Rifle Association, had not sufficiently shown they would suffer irreparable harm without a preliminary injunction. She scheduled an October hearing on a permanent injunction.

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) ordered more than 8,000 gun dealers in Texas, Arizona, New Mexico and California to report the sale within five business days of two or more rifles to the same person.

Damn that pesky Second Amendment! Damn it to hell!

The ATF f’s up with Gun-Runner, and then mounts a fix by creating new rules that nobody can point to and state they would have resolved any issue on the table.

The ATF is the main problem. They are the entity that is out of control. Gun purchasers and gun stores are not the problem here.

If you run a gun shop, post a prominent sign...

“All sales of two or more rifles within 5 business days must be reported to the ATF. For your safety and protection we strongly suggest you limit rifle purchases to single units until six business days have elapsed. Thank you for your patience and understanding in these dark days. - The Management”

If I owned a gunstore there I’d simply not obey this rule, period. The 4473s would be lost before they could make into the fireproof safe the government ‘requires’....this - all of it - is against our rights affirmed by the second amendment.

BATFE has NO lawful authority for this new “regulation”, and they know it.

This is a stretch they hope to get away with, despite their pious claims that ‘WE do not make the law”, in this case that is EXACTLY what they hope to do.

This is not a question of harm; it is one of whether the government has the authority to act at all, the court included.

Every single gun dealer should do this. It is a clear violation of the rights guaranteed by the Second Amendment. It is nothing but an infringement on citizens' right to keep and bear arms.

Of course, all anti-gun laws, regulations, ordinances, codes, bad feelings--whatever--are patently unconstitutional and, therefore, illegal. All of them. Concealed carry permits equate to asking permission to exercise your rights. Open carry is the only deterrent that makes sense. When citizens open carry, everyone understands the message: Don't Tread on ME.
