But let me point out that this wasn't a criticism of Perry because nowhere in his disjointed secession remarks did he say or even imply that Texas had a special right to walk out of the Union. He is no doubt aware of the Constitution and it's limitations. So if anything, I was criticizing the bone-headed author of the article and not Perry. All he did was make some remarks that he'll spend the campaign trying do defend when asked about them.

Give what a rest? The truth? SJC is correct all Sates entered the union on the same footing and rights. Besides if you want Texas to secede you have to climb over Texas v. White.

In the 90’s I paid some Constitutional lawyers a lot of money to tell me if there was ANY path where Texas could secede. There is no path and all the “rights” the secessionists are claiming were given up at the end of the Civil War.

Perry is just pandering and bordering on treason.

But he's right... See the US Supreme Court decision Texas v. White from 1869 which found 'that the Constitution did not permit states to unilaterally secede from the United States, and that the ordinances of secession, and all the acts of the legislatures within seceding states intended to give effect to such ordinances, were "absolutely null"'.

Secession of a State only happens, per the SC decision, with the consent of the remainder of the States.
