BULLITT COUNTY, Ky. -- A proposed smoking ban in Bullitt County has been snuffed out.
The Bullitt Circuit judge issued his ruling Thursday, saying the ban proposed by the health department is void and unlawful.
The board of health had voted to enact a regulation to ban smoking in public places, but Wednesday's ruling stops the health department from implementing or enforcing the ban.
In that ruling, Judge Rodney Burress said to allow the health department to regulate any matter relating to public health would "allow regulations prohibiting the consumption of candy because it is bad for a person's teeth, to prohibit consumption of deep fried foods, and to limit the consumption of red meat."
He went on to say, "The people of Bullitt County are entitled to be governed by elected officials and not an administrative agency."

Am against smoking for religious reasons. Your body is the temple of the Lord so don’t abuse it.
However agree with not wanting the Gov. telling us what to do.
I grew up in Bullitt County. Everybody smoked. There’s no way they’d stand for a smoking ban!
What a novel idea! Too bad we don't have federal courts that understand this.
Especially since we are now being ruled entirely by administrative agencies working as surrogates of Herr Leader.

This theory of second hand smoke has always been a bother.
The direct research has never existed. It is all “extrapolated” from a multitude of research projects (some somewhat monitored, others done in the basment of anti-tobacco activists).
Ask for the proof, and you’ll get a stammering reply of the sort the global warming alarmists use.

Now that is a heartwarming quote coming from a public official especially a judge. Good for him, using his common sense.

A number of years ago there was a community in Florida that had a proposed smoking ban on the ballot. If I remember correctly, only about 47% of the town's people showed up to vote on it and it passed with something like 52% of the total votes cast.
When you look at the real numbers, that means that only about 24% of the total number of registered voters were able to mandate how a private enterprise must conduct business on their own private property..........
That's tyranny by the minority....

I suspect that you are referencing the statewide ballot initiative in Florida. I don’t remember the year eather, but it was also the same ballot where the same voters approved giving pigs constitutional rights.
