Girl, 13, was 'gang raped after rigid school rules meant she had to stay late and missed bus home'

A schoolgirl was brutally gang raped after rigid school rules meant she was kept late and missed her bus home, it has been reported.

The 13-year-old's parents are suing Mount Hope Middle School in West Virginia, claiming the horrendous sexual assault would not have happened were it not for the actions of staff at the school.

The girl was allegedly set upon by a group of athletes at the school while waiting outside for a ride home.

She had missed her bus after being made to collect uniforms for the cheerleading squad by Linda Nevi, the coach.

When the girl, who was the middle school's cheerleading captain, then went to the school's office to ask to call home, she was told she could not do so and had to use a friend's cell phone instead, the case alleges.

She then allegedly went back to the school office to wait there but it was locked and staff had gone home.

She also is said to have tried to wait inside the gymnasium but was then told by the basketball coach, Bo Morrison, that she could not wait inside while practice was going on.

'While sitting outside the gymnasium, Plaintiff B.E. was confronted by various male Mount Hope High School student athletes,' the lawsuit alleges.

'The student athletes forced Plaintiff B.E. to a room commonly used by students at Mount Hope High School to engage in sexual acts.

'In this room, the student athletes raped and physically and sexually assaulted Plaintiff B.E. while another female juvenile was present.

The boys are said to have been older, aged between 16 and 17.

Mount Hope High School was forced to close this year due to consistent underperformance; its students now attend Oak Hill High School.

the place apparently isn't exactly an emblem of anything but incompetence and failure in the first place.

I believe at that age, with the boys what, 16 yo max, these consensual trysts are called juvenile delinquency not rape.

Legally, schools have ‘door to door’ responsibility for their students. That’s why if kids vandalize mail boxes while on their way to school, for example, it’s the school that has to deal with the issue. At least that’s the way it was when I took a law class for teachers a number of years ago. This school absolutely was responsible for what happened to this girl.

According to news accounts, nothing did happen to her. NO DNA from multiple rapists, inconsistent stories, video evidence she lied and the victim actually recanting her accusations.

There are also a few reports she was being bullied and harressed to recant her accusations. It got so bad she had to transfer to another school.

She has 2 lawyers who have taken her case. I am sure they feel the crime was committed.

And besides she is only a 13-yr old cheerleader. Adults and bullies can scare her into saying almost anything. She is probably scared to death what she is hearing.

I believe the school covered this up for reasons that will hopefully come out in trial.

No DNA, and video of her walking into the room, and her recanting, are huge problems.

They can say she didn’t recant all they want. The police will have recorded what she said.

I think the lawyers see a large profit...

That’s the real story, that they had a team of athletes at the school who would just rape a girl, if the story is true.

How could the school expect that a kid would get raped at school?

Doing some checking this was a Grades 5 to 12 combined elementary, junior high and highschool.

We are talking about a 13 year old claiming an attack by adults ~ presumably athletes!

You'd better believe anything that involved the student athletes is/was highly important in that town.

This area is near the NEW RIVER, which is the OLDEST RIVER.

You are probably right. The athlete-rapists could be from “connected” families. The county judges are too wired so a Federal suit was filed. All of this is possible

A lawsuit would be the last thing that school would need to worry about that had been my daughter. I’d have a line of heads on silver platters at my feet over that.

Well, if the parents of this young lady followed this same path, it's possible some innocent young men would be dead.

This doesn't involve blacks and hispanics out in a rural area in Texas ~ but rather highly sophisticated coal miner's kids who know all about contraceptives.

They all have the same low grades which is why they imagine they can get away with this sort of thing.

Condoms won’t keep your DNA off of your victim.

Besides that, they can tell if a condom was used during a sexual assault.

So the condom idea is a non-starter, imo.
