I hope that all those who denied her refuge and help find their souls scraped and scarred for life, with the knowledge of their complicity.

'The student athletes forced Plaintiff B.E. to a room commonly used by students at Mount Hope High School to engage in sexual acts.

They had a whoopee room? The school did nothing about the whoopee room?

Complicity? Really? Aren’t ONLY the rapists responsible for the rape? No other person denied the girl protection knowing that it would be needed. Only the rapists are really at fault here.

"He says these include a lack of corroboration between the stories of the alleged victim and the other female student who was present, as well as video surveillance footage that showed the girl apparently willfully walking into the room where she claims she was raped. England says she had reported being abducted by the males and forced into the room."

Something is not jiving.

If those “student athletes” are hungry for group sex, perhaps a little jail time in the pen would satisfy their appetites.

well vlad, when my husband was a high school teacher, kids who were at the school after hours were always supervised, no one was left unattended and vulnerable. When a girl needed a ride home, he called me, and we both went together to take her home, and make sure she got inside her house safely.

This was a small rural school, so maybe things were different, but nobody would have left a girl vulnerable, with no way to call her parents. I blame the school staff who failed to help her.

A lawsuit would be the last thing that school would need to worry about that had been my daughter. I’d have a line of heads on silver platters at my feet over that.

On the other hand, this is another reason that home schooling is a very viable and desirable option.

False claims are destruction for legitimate rape victims.

She should be made to face the damage she has done and HER parents should be sued.

Mount Hope High School was forced to close this year due to consistent underperformance; its students now attend Oak Hill High School.

the place apparently isn't exactly an emblem of anything but incompetence and failure in the first place.

would not have happened were it not for the actions of staff at the school

Rat-like thinking: 'school staff' didn't assault this child, the rapists did. Personal responsibility people.

I believe at that age, with the boys what, 16 yo max, these consensual trysts are called juvenile delinquency not rape.

Legally, schools have ‘door to door’ responsibility for their students. That’s why if kids vandalize mail boxes while on their way to school, for example, it’s the school that has to deal with the issue. At least that’s the way it was when I took a law class for teachers a number of years ago. This school absolutely was responsible for what happened to this girl.

According to news accounts, nothing did happen to her. NO DNA from multiple rapists, inconsistent stories, video evidence she lied and the victim actually recanting her accusations.

There are also a few reports she was being bullied and harressed to recant her accusations. It got so bad she had to transfer to another school.

She has 2 lawyers who have taken her case. I am sure they feel the crime was committed.

And besides she is only a 13-yr old cheerleader. Adults and bullies can scare her into saying almost anything. She is probably scared to death what she is hearing.

I believe the school covered this up for reasons that will hopefully come out in trial.

No DNA, and video of her walking into the room, and her recanting, are huge problems.

They can say she didn’t recant all they want. The police will have recorded what she said.

I think the lawyers see a large profit...

That’s the real story, that they had a team of athletes at the school who would just rape a girl, if the story is true.

How could the school expect that a kid would get raped at school?

Doing some checking this was a Grades 5 to 12 combined elementary, junior high and highschool.

We are talking about a 13 year old claiming an attack by adults ~ presumably athletes!

You'd better believe anything that involved the student athletes is/was highly important in that town.

This area is near the NEW RIVER, which is the OLDEST RIVER.

You are probably right. The athlete-rapists could be from “connected” families. The county judges are too wired so a Federal suit was filed. All of this is possible

Well, if the parents of this young lady followed this same path, it's possible some innocent young men would be dead.

This doesn't involve blacks and hispanics out in a rural area in Texas ~ but rather highly sophisticated coal miner's kids who know all about contraceptives.

They all have the same low grades which is why they imagine they can get away with this sort of thing.

Condoms won’t keep your DNA off of your victim.

Besides that, they can tell if a condom was used during a sexual assault.

So the condom idea is a non-starter, imo.

False accusations cost an associate his family, his job, and career. The accuser recanted just prior to the trial, but the damage was done. In these cases you are guilty until proven innocent.

All it takes is a lie from the other party.

I am only playing devils advocate here, but consider it carefully before you pull out the tar and feathers.

Condom trace evidence is well known in law enforcement. It would be standard procedure to check for the various types of trace evidence that a condom always leaves.

Besides, there’s all sorts of other DNA transfers that can occur during a sexual assault, and the likelyhood of these transfers is much greater with a gang.

Had she been assaulted using condoms, the police would be able to tell and prove it.

They would possibly even be able to prove the brand of condom.

In the LAX case, the accuser changed her story to add condoms when the DNA evidence didn’t show up, but that story didn’t work, either.

Use of a condom is obvious during a sexual assault exam and tests.

This is true..at least where I teach and coach. This seems to be a mixed level school. Mine is a middle school. I am to stay and watch any of my female athletes until they are in the car or bus home. If their parents don’t come for an hour it doesn’t matter. I stand at the front of the school til they arrive. High school coaches in the same district are not required to watch the athletes beyond the time they leave the locker rooms to head home. Many drive so maybe that is the distinction. If this happened in my building we’d be liable.... big time. Whether she was actually raped or not...we should have been there.

“Namely, he (prosecutor) says that when he interviewed the young woman in January 2011, she recanted her allegations of being abducted and vaginally raped, claiming only that she was pressured into oral sex.”

Well that explains it then. No sex was involved as far as the prosecutor admits to knowing.

Isn’t humanism great?

Like I said, if you look for it and write it down.

They have FOUR (4) police officers there. Hospitals ~ go to Beckley WV, or drive off somewhere else also some distance away.

You actually could have a situation where a town that has maybe one rape a year was not prepared to peform an examination ~ or to do it correctly.

This is not a heavily urbanized area.
