Judge: Americans have no right to choose food

A Wisconsin judge has decided – in a fight over families' access to milk from cows they own – that Americans "do not have a fundamental right to consume the milk from their own cow."

The ruling comes from Circuit Court Judge Patrick J. Fiedler in a court fight involving a number of families who owned their own cows, but boarded them on a single farm.

The judge said that's a "dairy farm" and is subject to the rules and regulations of the state of Wisconsin.

"It's always a surprise when a judge says you don't have the fundamental right to consume the foods of your choice," said Pete Kennedy, president of the Farm-to-Consumer Legal Defense Fund, which worked on the case on behalf of the farmers and the owners of the milk-producing cows.

versus
Everything is forbidden which is not expressly allowed.

USA used to be the first kind, heading to the second.

An interesting side note, milk was originally pasteurized to prevent brucellosis for one thing. However in the Yellowstone area judges are upholding the right of the federal government and environmentalists to keep the disease alive and well and allow infected animals access to private property. There have been 17 brucellosis outbreaks in privately owned livestock in the area since 2004, and a number of entire cattle herds destroyed when they became infected. It had been about 20 years prior to that since cattle had been infected thanks to vaccination. The herds that have been infected were also vaccinated.

What was that new farming regulation that outlawed growing your own food? Many people laughed at that idea...but this ruling seems awful darn close...

Jonty30, it doesn’t surprise me either. If government has the right to tell people what to eat, it also has the right to tell them what NOT to eat. Justice Kagan would no doubt uphold this ruling in an appeal.

As usual, WND is distorting the ruling and the meaining. The ruling can be found here:

This is a summary judgment ruling. It says the case goes to trial because there are TWO sides to the issue.

The ruling specifically says that someone who owns a cow and sells the milk can drink the milk directly from the cow if they wish, as can their family.

However, the state is arguing that the arrangement made is a sham, designed to allow the sale of raw milk to the public. The ruling does not agree with that description, but says it needs to go to court to see if it is true or not.

This is the prevailing mindset of the left - only the elite are capable of making their own decisions, and they therefore have the obligation to make YOUR decisions for you.

This case is NOT about what a person has the right to eat, but what a person has the right to sell. Please don’t read WND & think you are getting an honest report.

This is a summary judgment. That means the facts in the case are in dispute, and must therefor go to trial. The plaintiffs argue they are not selling raw milk. The state says they are, and have denied them a business license. The facts are in dispute, so it needs to go to trial.

That is all this ruling says.
