Federal District Judge Sharon Lovelace Blackburn again refused to halt Alabama's tough new immigration enforcement law, pending appeal - this time turning back an "emergency" request by the U.S. Department of Justice and left-wing non-profits who advocate for illegal aliens. She upheld provisions which authorized police to detain people suspected of being in the country illegally if they cannot produce proper documentation when stopped for any reason, among other provisions.

Blackburn said...that the law's challengers, including President Barack Obama's administration and civil rights and immigrant advocacy groups, had not shown they were likely to prevail in their efforts to get the law struck down. She also found the public interest would not be harmed by letting the measure stand while the groups appeal to the U.S. Court of Appeals for the 11th Circuit.

"Alabama has an interest in enforcing laws properly enacted by its Legislature and not likely to be found unconstitutional," the judge wrote. "Moreover, the public has an interest in having properly enacted valid laws enforced."

Amen to that. Her opinion that H.B. 56 is "not likely to be found unconstitutional" is causing deep concern among advocates for illegal alien amnesty, and stands in strong contrast to Judge Susan Bolton, whose outrageous ruling blocking similar provisions in Arizona's S.B. 1070 was littered with political and emotional excuses, and short on legal reasoning.

With her ruling, the provision to detain illegals is upheld, along with provisions that permit the state to require public schools to determine the legal residency of children, allows Alabama to bar illegal immigrants from commercial contracts with state or local governments, applying for or renewing drivers' licenses and identification cards or seeking license plates.

The new law continues to reap early dividends, when an arrest yesterday of a man wanted for first degree child sexual abuse releaved he was a Guatemalan national in the U.S. illegally. The case demonstrated an additional benefit of H.B. 56 - the ability to hold illegals indefinitely. The bond for 28 year old Juan Vargas was set at a ridiculously low $10,000 by the judge - for 1st degree sexual abuse of a child! - but thanks to the new law, Vargas will be held without bond, and will also be placed on ICE retainer. This “emergency” request by the U.S. Department of Justice , how weird is that ? emergency” request by DOJ against Alabama for having laws that will catch criminals and team Obama is not happy with us being a nation of laws. I think this is more like an emergency” request made by Mexico by way of the DOJ.Mexico does not want all her people to be sent home.They would rather the U.S. be the true provider for all their citizens here and have them remain here and be our problem. It’s nice to see for once we are moving forward and enacting laws that are already in place, but are not being enforced. Be interesting when the debates come to hear what Obama will say about Alabama and and the other states for wanting to have laws that address illegal immigration.

This law is already showing wonderful results here in Alabama as illegals are self-deporting in droves. I feel sorry for the neighboring states that have no laws in place as the illegals are now flooding there, but we here in Alabama have set the precedent.

There is a lot of whining from schools that have seen a bunch of students suddenly not showing up, and farmers who are now having to actually HIRE workers to work their fields — but I have little sympathy for anyone who plans or bases their livlihood/business on the exploitation and use of criminals as their labor force.

They now have a clear and clean way to resolve their invasion problem if they have the guts, wisdom and fortitude to do so. If not then they have only themselves to blame.

Rather doubt it. It sounds like this judge found enough existing law to allow the contested provisions to stand and had no reason to go the other way...

Then again, there may be some on the bench who are sick and tired of the current Executive Branch. The Chief Justice of the USSC comes to mind.
