College Diversity Nears Its Last Stand

ABIGAIL FISHER, a white student, says she was denied admission to the University of Texas because of her race. She sued in Federal District Court in Austin, causing Judge Sam Sparks to spend time trying to make sense of a 2003 Supreme Court decision allowing racial preferences in higher education. “I’ve read it till I’m blue in the face,” Judge Sparks said in an early hearing in Ms. Fisher’s lawsuit. But the meaning of the central concept in the decision — “this esoteric critical mass of diversity of students,” he called it — kept eluding him.

The 2003 Supreme Court decision he was trying to understand, Grutter v. Bollinger, had elevated the concept of “diversity” from human-resource department jargon to constitutional stature. The pursuit of diversity, a five-justice majority said, allows admissions personnel at public universities to do what the Constitution ordinarily forbids government officials to do — to sort people by race.

Judge Sparks in the end ruled that the Grutter decision meant that Texas was allowed to take account of Ms. Fisher’s race. Now her case is hurtling toward the Supreme Court. That could provide a fresh opportunity to consider what we mean when we talk about diversity. It could also mean the end of affirmative action at public universities.

Ms. Fisher’s lawyers filed a petition seeking a Supreme Court review last month, and legal experts say the justices will probably agree to hear it, setting the stage for a decision by June. Such a decision, given changes in the membership of the court since 2003, is likely to cut back on if not eliminate the use of race in admissions decisions at public colleges and universities.

They tout this nebulous concept of diversity, meanwhile ensnaring millions of brown and black (and white) people with easy, limitless debt —NONE of which is dischargeable via bankruptcy.

IT IS A FORM OF FRAUD and it is a BUBBLE.

They’re graduating the the debt equivalent of a HOUSE, but with NO HOUSE.

What woman would wish to marry such a debtor?

THIS IS FRAUD.

Banks were said to be TRAPPING people in liar loans —why not Universities...?

Fraud is OKAY —for LIBERALS.

When I was a teenager (and that was a long time ago) I wanted to apply for a job at Sears department store. A family member already worked there - she asked in the HR department about open positions. Her friend in HR asked “Is ransomnote white?” My sister said “well, yeah” and the HR person shook her head and said “no, we are required to hire a diverse applicant” and that there was no point in my applying for work there.
As I understand it - Asians in the US have the hardest ‘racial’ time getting into college because their demographic is considered ‘over represented’ and therefore their applications tend to be passed over for ‘less fortunate’ minorities and...whites.

In large companies, diversity is about hiring and promoting people based on skin color and sex, and then pretending that it was solely on the merits, and that skin color and sex had nothing to do with it.

The Grutter opinion was incoherent. Sandra Day O'Connor wrote it. It elevated "diversity" to the mystical and constitutionally irrelevant level approached in the Casey "sweet mystery of life" decision, or the "penumbras" and "emanations" discovered in Roe.

One of my best buds is Asian. Filipino to be exact, and he’s right-wing. Even though he has a better chance of getting in by checking the “Asia/Island Pacific” race box, he doesn’t. He wanted to get into the course based solely on his grades.

And what pisses him off is that nowadays, you “have” to speak Spanish in L.A. to get a job and he doesn’t. He actually does NOT want to learn because his logic is that “if these mexican libs keep harping about MULTI-CULTURALISM’ then shouldn’t they ALSO learn Filipino? MULTI means MANY. Why are we the ones bending over to these burrito-eating jackholes?” He part-times at the Conservative Club for Growth.

The articles I read on Asians being ‘over represented’ tend to be CA universities (private and pub) rejecting students of Japanese descent.

When my sister worked in an academic setting, she learned to demand that others correctly identify HER ethnicity. They would mutter dismissively ‘well, WHITE’ obviously. She would arch a brow and explain to them that WHITE wasn’t an ethnicity, it was a skin color. She would continue to demand they identify her ethnicity. They would stammer ‘Irish, English or German -they are all the same’. She would frostily tell them that they were insulting her with their ignorance of her proud cultural heritage, with their assumption that there is just one monolithic ‘race’ of ‘white’ people instead of rich diverse cultural identities, and by implying that the culturally respectful correct identification of her ethnicity was not important because how could her ethnicity be less important than theirs....? She suggested archly that they may want to become open minded culturally sensitive global citizens and begin to appreciate cultures that they have overlooked or denigrated and that it was never too late to start. Oh and if asked, she never failed to identify their ethnicity correctly - they had already made sure everyone knew.

The way you take care of this is to gradually denigrate the value of marriage in a minority community. When it is seen as something undesirable, your question is no longer an issue. It's all about the culture.

I think we should DEMAND diversity in the NBA and the NFL.

Neither the NBA nor the NFL “look like Amercia” to coin a phrase from the liberal progressives. We need to see 80 percent white and 20 percent minority in both of these professional leagues.

Miss Fisher went about it all wrong. OK, she may have gone about it right if her goal is to topple a SCOTUS ruling, but if she wanted to get into the school she should have done what I did: check the “black” race box on the application. No one checks to see if you’re actually the race you selected—you turn the application in, it gets thrown in a pile with the others and you’re long gone when someone actually reads it. Keep in mind that you’re dealing with a huge bureaucracy that can be manipulated to your advantage. I even won scholarships that I’m pretty sure hinged on my “blackness” even though I’m white as rice.

I found the above to be VERY INTERESTING. Apparently, the Asian Pacific American Legal Center and other Asian groups are there to KEEP ASIANS OUT OF COLLEGE.

That just shows how liberal-infested these groups are, and how the (legitimate) immigrants of this country are being SHAFTED by the liberals claiming to represent them, but (apparently) don’t know our culture well enough to take control themselves.

Sure, it's easy. Just take a given student population and show it to Hillary Clinton. She will tell you, in five seconds flat, whether it is the correct critical mass ratio of races.

I don't know why people think this is so hard - or why they try to do it without Hillary. After all, these policies and laws were made FOR her oversight in the first place. Sheesh.

Yep. I witnessed this first-hand when I worked for a large construction company (ISEC, Inc.). They were focused on hiring based on “diversity” rather than on “qualifications”. It was a real nightmare trying to do my job while trying to train unqualified morons to read blue-prints. Most of those “diverse” employees were hired based solely upon their “ethinicity” and were then fired when the construction industry took a nose-dive in 2008.

Stoopid company with a lot of stoopid politically correct idiots running it.

I recall reading O'Connor's decision, in which she claimed "a compelling state interest in academic 'diversity'".

And, as with most of her decisions, I wondered "What the hell is she talking about?"

Her decisions invariably read like "Mommy, trying to be 'fair'".

Miss Sandra was not President Reagan's best moment...

That might work but...

I recall some firefighters in San Jose California got in trouble for doing that. They realized it was the only way to earn a promotion so a few of the white firefighters checked the ‘black’ box. All I recall is threats of suspensions for lying on an application - I don’t know what happened.

Why hasn’t the strongly Republican Texas state legislature, and Texas’ conservative-on-everything-except-immigration governor done anything about this? Maybe the governor has no authority over this in Texas, but surely the Texas legislature could stop Texas’ public universities from using racial preferences.

I suspected the federalization of the college loan program would mean indentured servitude... but I didn't get the economic/ethnic angle.

That move was on behalf of the university faculties and administrations, not the students.

Well, the SC may take it out before this happens, but I always figured that it would collapse when a definitively “white” appearing student is denied entry and then shows DNA/genealogy showing they are 10-20% African.

Once they have to start doing elaborate genetic tests and specifying racial percentages to several decimal points the system can’t survive.

I'm as white as you can get, but I've done some thorough genealogical research and discovered that one of my ancestors was a pre-Revolutionary African slave in Rhode Island. I am tempted to have my daughter use this fact to her advantage in this Brave New World of racial nose counting.

If they were a large construction company, then they probably wanted to bid on projects for government entities who would have made having a "diverse" workforce a requirement for consideration. Even projects for large companies would have probably have a question on the bid application about the racial makeup of the company (no major corporation wants heat from the Jesse Jacksons and Al Sharptons of the world about hiring "racist" construction companies)

One of the biggest things we could do to improve education would be to resume educational loans being discharged in bankruptcy, and make the colleges be co-signers on the loans.

Overnight, colleges would stop offering majors that did not lead to paying jobs (unless the student paid cash in advance), and stop accepting unqualified students.

Years ago, when this crap first started, a buddy of mine was hauled before management to explain why he hired a white guy over a black guy. One lib, ever so ready to exploit “racism”, asked, since they were both equal to the job, why did he hire the white man?

He said he realized both were equally qualified, so he used his binary computer to make the decision. Lib jumped all over it, asking what kind of “binary computer” (sneering) did he use?

He took out a quarter, flipped it and said, “Heads: The guy on the left gets it; Tails: The guy on the right.” He didn’t even use “black guy/white guy”.

The lib sputtered while a couple others laughed, and that was the end of that.

Mebbe an Urban Legend, but a white college applicant checked off the "Native American" box. In the "Tribe" box he put "SoSueMe". He was accepted.

Good idea, it would certainly cull the ones who don't belong.

It would shift scholarship money away from deserving students to cover their liability, though. Most of the smaller, private colleges do this. If they didn't, no middle class kid could begin to afford to attend. It's these smaller, less prestigious schools that are serving the most talented and capable of students, the "Name brand" schools are shunning these kids in order to fill quotas. Remember the day when Rutgers University was considered Ivy league?

My daughter is in school on such an arrangement, and what we pay is within reason-- on the scale of what it cost kids to attend before the inflation bubble.

Eventually schools will close. Somebody might get a clue and establish a "bare bones" college, one that concentrates on a general core curriculum. Students would have a limited range of majors, concentrated on general disciplines: math, English, languages, history etc. Facilities would be limited to classrooms and small lecture halls; no stadiums, arenas, research facilities, architectural monuments, football teams, etc. Finding competent faculty would be easy enough.

Imagine if 90% of tuition was devoted to teaching instead of the usual ancillary crap. Costs would be within the reach of any motivated student.
