U.S. Army Special Forces Sgt.1st Class Kelly A. Stewart admitted to having a one-night stand with a 28-year-old German woman the night of Aug. 22, 2008. She did, too. Both knew sex was part of the plan when they left the discotheque near Stuttgart. Two months later, however, her story changed and the highly-decorated combat veteran found himself facing rape and kidnapping charges.
During court-martial proceedings one year later, Stewart faced an Army court-martial panel comprised of soldiers who had recently returned from a 16-month deployment with the Army attorney serving as Stewarts lead prosecutor.
Despite a lack of both physical evidence and eyewitnesses to the alleged crimes, it took only three days for the panel to find Stewart guilty of numerous offenses including aggravated sexual assault, kidnapping, forcible sodomy and assault and battery and sentence him to eight years behind bars.
Incredibly, the conviction was based almost entirely on the testimony of Stewarts accuser, a one-time mental patient who, with the backing of the German government, refused to allow her medical records to be entered as evidence.
When several witnesses came forward during a post-trial hearing to reveal startling proof that the accuser had lied several times during the trial, their words were largely ignored by the court and Stewart remained behind bars.

It is disgusting that this “Army” allowed conviction of this Special Forces HERO without evidence and in spite of the dubious motive of the accuser! I find this criminal on the part of the “Army” but even destroying this Hero's life doesn't’ seem to be enough for them! Now they want to torment him further and make things as difficult as possible for him and his soon to be deployed wife!!!
The conviction of Special Forces First Sgt. Kelly Stewart is disgraceful and in my opinion, does a disservice to the Army and all who wear the uniform. I don't know how those involved in this conviction can look themselves or anywhere else in the eye. It is horrendous and shameful, what they have done to this Warrior's life and to his family.
Please read Kelly's story and email the webmaster, who is his highly decorated father! Please donate to this family and please send a scathing email to Josue Robles and John Abizaid. Please spread the word what USAA has done to this family. Frankly, they are not worthy to hold accounts of Heroes such as Kelly Stewart!
You all know, I have been heavily involved in trying to help Michael Behenna and the Leavenworth 10. I now add Kelly Stewart to the list! This is truly times that try men's souls but I am a Warrior too and I'm on the warpath! These men are all our Sons and this persecution of our Warriors has got to stop!
Please engage and help this family. Through 3 deployments, Kelly Stewart served to protect us and keep us safe. Now he needs our protection!

I’ve seen this happen here stateside, too. On a Navy ship stationed out of Norfolk circa 1992, there was an E-6 Fire Controlman who had sex with a woman that he met at a bar. She was married to another Navy guy and admitted that she wasn’t wearing her ring and didn’t tell the guy she was married. She went to on-base counseling because she felt guilty about the whole tryst and they pushed her into pursuing rape charges.
This poor dude was convicted and sentenced to 10 years. After her marriage fell apart and this guy had already done 18 months in prison, she admitted that she made the whole rape story up and the guy was freed. But he’d never get that year and a half of his life back. His career was completely trashed and his family was devastated. Wherever he goes, most people think of him as the rapist who got off on a technicality. I say Navy Family Services sucks.

Thank you for posting this. Horrible. Of a piece with the multiple unncessary courts martial that have been convened against our troops for the past eight years.
One egregious example is that of Army Lt Behenna. Meanwhile, Marine Sgt Wuterich just learned that he will be court-martialed for something he has been fighting in the courts for years.
However, when one puts all this against the backdrop that murderers/maimers of our troops are currently being released from confinement in both Iraq and Afghanistan, it becomes more than simply an injustice.
Though I am no longer in the military, I did start with USAA decades ago, when I was. I have been less than pleased with their service of late. This is just over the top.
Any suggestions for a replacement company for USAA for auto and home-owners’ insurance?
You said it right. Seems in the Military Justice System you are guilty and must prove your innocence. And by the way, you must do it without presenting witnesses or information which might reveal something about your accuser.

Yes, Kelly Stewart was found guilty based on an accusation with no actual evidence. Just the words of the accuser whose background information was not allowed to be heard in Kelly’s defense.

A letter from you concerning your displeasure with their company over their treatment of Kelly Stewart would be exactly what they need to receive!
Sorry I do not have a suggestion for a replacement insurance company, but if I were you I certainly would shop around and end any service with USAA!

I do not condone his action, but can certainly understand a soldier away from home having a weak moment and making a mistake.
My question is, do married folks go to jail for having a one night stand outside of marriage? No. And in Kelly Stewart's case, he was not allowed to defend himself against the false accusations the woman made four months after their consensual encounter.

Seems someone had no “power of attorney” when attempting to access funds and other benefits in the USAA accounts. That is entirely appropriate and keeps scam artists at bay. Any compliants based on this are absolutely bogus! I am a longtime USAA member and would be very PO’d to find out that an imposter had dipped into our funds without authorization! You complainers and whiners can kiss my butt, because my assets in this co-op are NOT just sitting there for your pleasure and benefit!!

I did and responded appropriately to the lack of a power of attorney on the part of anyone other that the principle party. Been there, done that, grasshopper and I completed the appropriate paperwork PRIOR to deployment!! Yeah, he got screwed twice, three or mebbe even four times, but none of was due to USAA or the rest of our co-op members. You are an idiot!

I believe you missed what Kelly’s dad said. He was not trying to access funds in Kelly Stewart’s account. Kelly’s dad was questioning USAA about why they canceled Kelly’s coverage. The answer received from USAA was that Kelly did not meet their standards. Kelly’s father was questioning where their standards were stated, and what they were.
The hallmark of the obama pResidency is in justice, at every level the bassturd can manage! This is a rape of Justice, not emrely a miscarriage of justice! But what do we expect from an establishment mentality?

Granted our Military is a microcosm of US Society as a whole and there are 'bad apples' in every branch. BUT. I would argue - not likely in the U.S. Army Special Forces. And not for an E7.
If he was the 'crazy monster' he's made out to be by the prosecutors he never would have made it into SF, or lasted, and surely unable hide his 'evilness' all those years going from E1 to E7. He never would have made it past E5, if that, and would have been separated long ago.

Would have been more convincing to start the story with: "Kelly Stewart did admit to..being.. guilty of adultery, and understands that one mistake like that has ruined many a man's life who isn't an elite soldier, who doesn't have lots of people eager to send them money for legal defense....many who end up without a friend in the world.
