Righthaven misses deadlines, again faces asset seizure threat

In a familiar pattern, Las Vegas copyright lawsuit filer Righthaven LLC missed deadlines in two of its lawsuits Friday, prompting a creditor in one of the suits Saturday to again ask that U.S. Marshals seize its assets.

In the first case, Righthaven had until Friday to either pay prevailing defendant Wayne Hoehn’s $34,045 in legal fees or post a bond guaranteeing payment.

It did neither, prompting Hoehn’s attorneys at Randazza Legal Group in Las Vegas to ask U.S. District Court Judge Philip Pro to issue a writ of execution for Hoehn’s judgment.

The proposed writ requires the Marshals Service to seize Righthaven’s personal property.

This is the second time Randazza Legal Group has asked the court to order the Marshals to seize Righthaven's assets, which are thought to consist of some cash and the copyrights it claims to own.

The article does say its a firm that sues people for violating copyright protection.

Which I believe is baseless. “Fair use” is protected under the Constitution and I believe FR and bloggers would be able to prevail in court if sued.

Righthaven is one of those incompetent law firms that are essentially bill collectors. It gives me pleasure to see them going under.

Too big of a mess to type out. Simply a group of shyster lawyers teaming up with the Las Vegas Review-Journal on internet copyright issues. Free Republic was one of their targets/victims.

Source material from the Las Vegas Sun/Denver Post and other Righthaven companies can’t be posted on FR. Too much of a hassle even if people do nothing wrong.

Righthaven are just a bunch of thugs looking for quick and easy money. They’re not protecting the companies who hired them, that’s for sure.

They’re actually worse than bill collectors. According to the article, Righthaven is not a law firm and acquires copyrights strictly for the right to sue infringers, so its standing to sue has been an issue in most of its contested cases. Apparently, they actually want people or blogs to post their copyrighted articles so they can sue them.

Fair use allows you to quote from copyrighted works for educational and public knowledge purposes, to a certain extent. Of course the question is when Fair Use becomes copy right theft, that’s what the courts decide.
