Not only has Dr. Miley demonstrated there is firm underlying research in the LENR field, he/she has a commercialization plan. Relying on the microspheres Patterson-type patent gives them IP protection to go forward with a gas-loaded cell.
And we have more confirmation from NASA’s Langley Research Center, going back to August 2009:

Notice that he says "could", not "will". This is him speculating on what could happen if someone builds a working LENR reactor. You are reading way too much into this if you think it means that this will happen.
