Even if ObamaCare survives Supreme Court scrutiny next spring, its trials will be far from over. That's because the law has a major glitch that threatens its basic functioning. It's so problematic, in fact, that the Obama administration is now brazenly trying to rewrite the law without involving Congress.
The Patient Protection and Affordable Care Act offers "premium assistance"tax credits and subsidiesto households purchasing coverage through new health-insurance exchanges. This assistance was designed to hide a portion of the law's cost to individuals by reducing the premium hikes that individuals will face after ObamaCare goes into effect in 2014. (If consumers face the law's full cost, support for repeal will grow.)
The law encourages states to create health-insurance exchanges, but it permits Washington to create them if states decline. So far, only 17 states have passed legislation to create an exchange.
This is where the glitch comes in: ObamaCare authorizes premium assistance in state-run exchanges (Section 1311) but not federal ones (Section 1321). In other words, states that refuse to create an exchange can block much of ObamaCare's spending and practically force Congress to reopen the law for revisions.

I don't think that's the plan. The Centers for Medicare and Medicaid Services (CMS) are trying to force the states to run the exchanges or risk loss of support funds for their Medicaid systems. See The Federal Register, August 17, 2011.

Hmmm....I wonder if those of us who have insurance have “standing” enough to sue for remedy, given that the Obamacare law mandates the coverage of pre-existing conditions, thereby increasing our costs?
It’s my understanding that if previous conditions are covered, under most state laws the product ceases to be insurance anyway.

Levin, through his Landmark Legal Foundation, was critical in one of the appeals court decisions ruling ObamaCare unconstitutional. His argument against the individual mandate was adopted pretty much wholesale. LLF will be filing a brief with SCOTUS as well.
I would think, on this action by the IRS, someone would have to sue but who knows if anyone would have standing. Congress seems impotent.

I believe you devolve and I remember how outraged we were about all the ships, planes, armored cars and agents he takes along on his trips. Then they clear out any tourist who may be where they are going. They block off streets and whole areas, etc.

Independents and libertarian-leaning voters seem to think that gridlock is good because it means that huge budget-busting bills won't get passed. The same people merely have to look at much of Dubya's presidency as a counter-example.
The trouble with this thinking is that a political crisis, whether real or imagined, makes it easier for politicians to abuse their power. If there is a widespread perception that 1 government in general should be omnipotent and 2 that congress does not have the exclusive power to make laws, and 3 urgent action is required by the goverment, then divided government (something that the constitution most certainly allows for) becomes an excuse for the executive branch to do virtually whatever it pleases.
The observation that one should "never let a crisis go to waste" is incredibly cynical to those who think that is better to foresee a crisis and prevent it than to exploit one when it happens. Our government's fiscal situation is rapidly reaching a point of no return. The reason for this is not because we lack divided government. The reason is that advocates of big government who are in positions of power couldn't obey a law if they wrote it themselves. Until we depose those people, things will only get worse.
