David Codrea published an article today about an interesting letter one law abiding silencer owner received from the ATF. The silencer owner in question owns an AWC .22lr silencer that uses a material made of tangled copper ropes to slow down the expanding gasses, a material not unlike the common Brillo pad or Chore Boy Pot Scrubber. He wanted to know whether it would be legal to replace the worn out material in his legally owned silencer with some pot scrubber material, an act which seems pretty innocuous to the impartial observer. The ATF, on the other hand
From the ATFs reply:
[S]ound/gas absorbing materials manufactured from Chore Boy copper cleaning pads, along with fiberglass insulation, constitute a silencer.
Therefore, it is illegal for an individual to replace deteriorated material within an already- registered suppressor without an approved ATF Form 1, Application to Make and Register a Firearm, along with a $200.00 making tax and a no-marking variance since there is no viable area in which to apply a serial number to the sound-absorbing material.
So if someone wanted to replace the padding in their silencer theyd need to submit two new sets of fingerprint cards, two new photographs, a signature from their local chief law enforcement officer, $200 and a set of newly filled out Form 1 applications and then wait 4 months for a reply. All for an item they already own legally, and at the end of the day they will still have only one NFA item.
But thats not all. The original letter included a question about the owner of a legally owned silencer having a reserve of such pads. In case, you know, they needed to clean something. According to the ATF that would be considered a stockpile and considered an illegal act.
David has the full letter on his site which can be seen here.
I lost all of my brillo pads in boating accident.
Seriesly, we need to defund and abolish the ATF and make sure that former employees are prohibited from federal employment elsewhere, and not allowed to join a state, county, municipal, township, tribal, or territorial police force EVER AGAIN!.
BATF - The REAL gun NUTS!
When Brillo pads are outlawed, only outlaws will have Brillo pads.
ATF bureaucrats have taken complete leave of their senses.
Agreed. The ATF has gotten TOO FAR out of hand to be reformed. We have DHS and FBI we don’t need another FEDERAL POLICE force....
STUDENT 1: We've already been through apricots, apples, grapes, shoestrings, and pot scrubbers!
STUDENT 2: What if ATF comes at you with a pointed stick?!
I thought you were referring to a marijhuana scrubber...
The feds must show the movie `Brazil’ to new hires and tell them, “This is what it’s all about. Live it.”.
That was stupid. Why ask, just do it...what a sheep! How could they possibly prove the material in the suppressor wasn’t the original? Why would they even bother to look...unless the owner said something.
OTOH I completely agree w/ the first comment. Disband the ATF and investigate all personel for violations. Those that fail get max jail sentence in general population.
He must use that little silencer a lot.
We dont need the dhs or fbi either. Neither can obey the law...disband’em we’ll all be better off.
My wife is going to be mad that she can't get her Kitchen Cleaning supplies anywhere but there.
If you have some rubber stoppers and empty plastic water bottles laying about you are in violation for having silencer manufacturing parts.
So...this means 80% of US homes and ALL taco shops have illegal *stockpiles* of NFA weapons.
That is odd.. because the “Can” of the suppressor is the serialized part, not the baffles. If you get a baffle strike you ARE allowed to replace the baffles without paying the 200 fee and doing more paperwork.
Perhaps they mean constructing a device using Brillo pads being illegal?
BATF...BATF....Hmmm....now where have I heard of them...
Oh! That’s it. NOW I remember!!!
That’s that Federal Agency that BROKE FEDERAL LAW by allowing thousands of guns to be purchased by criminals, from law-abiding dealers, and then BROKE ANOTHER FEDERAL LAW by letting them go across the border into a soveriegn country, and then BROKE ANOTHER FEDERAL LAW, as well as MEXICAN LAWS, by letting them be used in crimes such as murder, and resulted in BREAKING ANOTHER FEDERAL LAW when some of those guns were used to MURDER US LAW ENFORCEMENT PERSONNEL...
That’s the same BATF who’s now lecturing someone on legality???
OKay...just so we’re all straight on who we’re talking about here...
That was my first thought. It makes for good publicity and any government authority is an easy target to make a fool out of.
Call it maintenance and do what you need to do.
I must resist...
They will be next to the cough syrup and foods cooked in saturated fat.
Unless of course you were an illegal immigrant that was a drug dealer. In that case they will buy the silencers for you with Stimilus Funds.
Was that 100 or 1000 silencers you needed sir? Will that be with or without guns?
Are they NOW going to outlaw potatos [the "poor man's silencer"] ...
Pillows too. We need to consfiscate pillows or arrest anyone caught with one.
Maybe...don’t think “sheep”....
Maybe think “part of the show”... or to put it another way, now they have an excuse to say what is and what isn’t legal regarding that issue.
Was that declaration ever part of the NFA34 firearms code, or GCA68 or any other law?
Or was it something that they just happened to need to clarify, and created a convenient excuse to do so??
After Fast & Furious, I put nothing past this regime. Nothing it too low for them to try.
And two-liter coke bottles.
So let me get this straight. The ATF won’t let me possess a box of Brillo pads, but the ATF will give the Mexican drug cartels assault weapons?
I dug more into the story, and found this ATF letter which....are you ready? Which states that a SHOESTRING can be a MACHINE-GUN.
Ya don’t believe it, right? This one was new to me:
Nice, huh? That is the original letter from the ATF.
This is the new trick in town. Just redefine the language to fit existing laws. No fuss, no muss.
Not to mention baffles in your motorcycle mufflers...
"OMG! It's a double-barreled motorcycle muffler baffle! Run for your lives!"
My dad showed me how to use oven mitts with my Beretta Tomcat .32cal.
Let them prove the material isn’t what came in it.
But the real question is...
Resist you "much"?
Clever...and, as yet, still legal.
I am being temp.....ted, must... re...sist...
I’m still waiting for my ATF approval letters for a couple of suppressors. It’s now been the “usual” 4 months. I called the gun shop and they said that the flow of letters from ATF has slowed to a crawl. They’re barely getting any lately... and it’s taking more like 5 months for most of them.
That’s what he gets for asking permission. He’d have been better off just doing it and keeping his mouth shut. Now he’s awakened the government beast and they are on his scent.
Exactly! Whats more worrisome is that such a rule doesn’t apply to nfa weapons. Its considered maintenance and for restricted parts one only needs the tax stamp.
Suppressed is Best
In the right hands, a scrubber is a very dangerous weapon.
I suspect a length of copper shielding jacket stripped out of a piece of coax cable would work just as well.
Quick ban copper tubing, you can make a still out of it!!!!!
Quick Ban everything, you can probably make something else out of it that is probably illegal!!!!!!
Gun silencers should be legal. Stop the irrational fear of tools, even deadly tools.
What I want is silencers for leaf blowers. Those drive me up the wall.
More proof that BATFAGS are light in the loafers.
Err..., uhh...,hey, that's racist!?....uhh, oh never mind. /sarc>
