Question: When abortion becomes illegal again, are we going to start throwing all the women who have abortions into jail?
Answer: No. The people who should go to jail in that case are the abortionists.
This particular question will be raised more and more as we to come closer to restoring protection to the unborn. The question is actually part of the well-planned public relations attack that abortion advocates always try to make on us in the pro-life movement. We are anti-woman, after all. Isnt that the only logical reason why we would oppose abortion in the first place? Thats what they want the public to believe.
Yet the fact is that to be pro-life is to be pro-woman. We dont say love the baby and forget about the mother. Rather, we ask, Why cant we love them both? This is not just true when abortion is legal. Its also true when its illegal.
The pro-life movement is not out to punish women. Our goal, instead, is to stop child-killing. What would throwing women in jail do to accomplish that goal? Their children have already died, yet the abortionist goes on killing hundreds and thousands of others. It makes far more sense to put the abortionist in jail, so that he or she can no longer kill children.
Moreover, the woman who gets an illegal abortion is the best source of information and evidence needed to convict the abortionist. If she feared prosecution, she would never admit to the abortion, which would make it harder to find the abortionist.
This doesnt excuse the womans wrongdoing; rather, it is the same principle by which the state grants immunity to a small-time drug user in exchange for information leading to a big-time drug dealer.

Women didn’t go to jail back in the old days when abortion was illegal or severely restricted across the country. Why would anyone think that women would go to jail if abortion is again restricted???
Abortion is murder for convenience. It’s also a medical procedure. It takes a “doctor” or at least a quack with a medical license to do them. If you want to get rid of 99% of the abortions, that’s the weak point in the system.
It’s unlikely the US would ever want to go there, not even in the case of a very tight ban. This would put it at odds with parallel laws about procuring killings, but better to stop the criminal liability at the abortionist than to risk losing the ban.
Those who advocate for abortion-murder should go to jail though.
Because the Police-State attitude is everywhere these days. For instance No-Knock raids.
They should. How can we make the argument that abortion is murder, but not treat both the performing doctor and the abortionist would be mother as murderers?
Mexican Judge Frees Women Jailed for Miscarriages
MEXICO CITY A Mexican judge ordered the release of seven women serving long prison term in the central state of Guanajuato after suffering spontaneous abortions, state Attorney General Carlos Zamarripa told Efe.
Last Friday, a judicial decree was published in Guanajuato reducing the punishment of women convicted of homicide in cases of miscarriage or spontaneous abortion.
With the new juridical concept, these seven women will enjoy their freedom this very night, Zamarripa said Tuesday.
The women, all of them poor and with little education, were serving sentences of up to 30 years after being convicted of killing their newborn babies.
One of the women has already spent eight years behind bars.
This case sparked unease among Mexican and international human rights activists and public criticism from U.N. officials.
Last week, Guanajuato legislators added new wording to Article 156 of the state penal code For the mother who deprives her child of life within the 24 hours immediately after the birth of the latter, and in addition if said deprivation is the consequence of motives of a psychosocial character, (a term of) three to eight years in prison will be imposed.
The women to be released are: Maria Araceli Camargo Juarez, Ofelia Segura Frias, Yolanda Martinez Montoya, Liliana Morales Moreno, Ana Rosa Padron Alarcon, Susana Dueñas Rocha and Bonifacia Andrade Hurtado.
Since 2000, more than 40 Guanajuato women have been put on trial for abortion, which carries with it a prison sentence of up to three years according to the state penal code, and nine of them are currently on probation.
Legislation regarding abortion varies among Mexicos 32 jurisdictions. While Mexico City permits termination of a pregnancy up to 12 weeks after conception, some states continue to treat abortion as a criminal offense.

Notice that it is not the misogynistic Catholic Church that is complaining about this miscarriage of justice.

Wrong, both should go to jail for first degree premeditated murder.
My heart agrees. My brain tells me that it's a well-intended, but potentially catastrophic gaffe in implying we send people to jail for beliefs rather than actual events - kind of like so-called "hate crimes".
IF you believe abortion is murder, then anyone who is part of this, the woman, the man who paid for it, etc should also be penalized. I say this only because it is hypocritical to only prosecute the doctor or assistants. You are then still giving the message that the only one who is participating in the abortion is the doctor.
This hypocrisy allows the pro life movement that wants abortion illegal to avoid the reality of everyone who makes the decision to abort the child. Of course prosecuting all who are involved will never happen and women will seek illegal abortions.
I believe if the pro life movement is to win, then other approaches must be used. For example, giving free sonograms to pregnant women has been shown to be the most effective in reducing abortions.
I remember when it was illegal. Quacks performing them in a motel room for big money. Infections and death from DIY. If it becomes illegal again you can count on an avalanche of press about the deaths of DIY, quacks, etc. Look for DIY abortion tools on the internet. There isn’t a good solution.
Therefore, I support no abortion unless it is a choice between death of the mother or child and then the mother would choose. In rape, no abortion, but the perpetrator made to automatically pay to victim. No lawsuit, automatic.
death threats are illegal. Advocating a crime should be a crime.
I disagree, both should go to jail, the abortionist for first degree premeditated murder and the woman for hiring a murderer to kill her baby.
