Two problems I see; 1) The Posse Comitatus Act prohibits US Military from civil arrest/confining within the US, and 2) The US Military has no jurisdiction for civil arrest outside the US. This is wrong no matter how you look at it.

Okay, according to this analysis, the ACLU might be engaged in a little hyperbole.

While S. 1235 had some very scary language in it, apparantly this one does not and applies only to foreign capture of noncombatants, but under the law of war.

LG is a disgrace to the Republican Party and South Carolina, no doubt.

Don't forget, though:

Sen. Kelly Ayotte (R-N.H.) also declared that the bill is needed because “America is part of the battlefield.”
It is positively shameful that the Republicans are backing this unequivocally anti-freedom bill, while the Dems oppose it. It glaringly shows the blind spot the Republican Party has regarding a sane and decent balance between national defense (involving almost exclusively foreign nationals and immigrants) and freedom for natural-born American citizens.

I hope our 2012 nominee will take this bull by the horns.

It would be helpful if the author would identify which sections of the over 600 pages of that bill were the cause for concern. Without seeing the offending language, fruitful discussion with meaningful input is not possible.

Is there any way to narrow this fearful warning down to its true dimensions? I have only read into it a few hundred pages, and I need some help to not waste my day...

"(b) Applicability to United States Citizens and Lawful Resident Aliens-

(1) UNITED STATES CITIZENS- The requirement to detain a person in military custody under this section does not extend to citizens of the United States."
