Effectively yes, and your point is well made as California and San Francisco have started and ramped up programs to keep as many criminals as possible OUT of jail or prison, including time served sentences, diversion, early release, mathematical trickery of "good time", and other legal tricks. The only guy that gets the maximum sentence is the photo red light violator.

The city will give a $10,000 city tax break to an employer that hires a felon over out-of-work Joe Honest with a clean record.
