Wagstaffs attorney, Deputy Public Defender Renee Rupp, argued that her client had not planned to kill his fiancee but panicked when he saw the law enforcement officer.
I guess he had to argue something.

The dumb cop was wrong here, the man was stabbing the woman and he broke the window and tasered the punk, a bullet in the head would have stopped the attack and save the woman's life.
