Not to defend Holder, who was lying, is lying, continues to lie, and should be impeached and imprisoned ... but his comment referred to "legal term of art" - he was speaking (as a lawyer) about mens rea, consciousness of guilt, which is necessary to prove if one is to prove crime.

By definition a “lie” always includes intent. An untruth could be due to actually believing the untruth. That doesn’t make it any less untrue, any less harmful, and always mean some level of incompetence, but it doesn’t necessarily mean there was intent to tell an untruth.

But when the incompetence gets grossly incompetent, it is safe to assume that a reasonably intelligent person would have known better.

Gross incompetence is a kissing cousin to lying.
