Department of Justice Releases Investigative Findings on the Maricopa County Sheriff’s Office
Department of Justice ^ | December 15, 2011 | Office of Public Affairs

Posted on 12/15/2011 10:11:23 AM PST by Beowulf9

WASHINGTON – Following a comprehensive investigation, the Justice Department today announced its findings in the ongoing civil rights investigation of the Maricopa County Sheriff’s Office (MCSO). The Justice Department found reasonable cause to believe that MCSO, under the leadership of Sheriff Joseph M. Arpaio, has engaged in a pattern or practice of misconduct that violates the Constitution and federal law. The investigation, opened in June 2008, was conducted under the provisions of the Violent Crime Control and Law Enforcement Act of 1994 and Title VI of the Civil Rights Act of 1964, and the Title VI implementing regulations.

The department found reasonable cause to believe that a pattern or practice of unconstitutional conduct and/or violations of federal law occurred in several areas, including:

•Discriminatory policing practices including unlawful stops, detentions and arrests of Latinos; •Unlawful retaliation against individuals exercising their First Amendment right to criticize MCSO’s policies or practices, including but not limited to practices relating to its discriminatory treatment of Latinos; and •Discriminatory jail practices against Latino inmates with limited English proficiency by punishing them and denying them critical services.

The Justice Department found a number of long-standing and entrenched systemic deficiencies that caused or contributed to these patterns of unlawful conduct, including:

•A failure to implement policies guiding deputies on lawful policing practices; •Allowing specialized units to engage in unconstitutional practices; •Inadequate training; •Inadequate supervision; •An ineffective disciplinary, oversight and accountability system; and •A lack of sufficient external oversight and accountability. In addition to these formal pattern or practice findings, the investigation uncovered additional areas of serious concern, including:

•Use of excessive force; •Police practices that have the effect of significantly compromising MCSO’s ability to adequately protect Latino residents; and •Failure to adequately investigate allegations of sexual assaults.

Obama to Holder, "Sic 'em, Eric, no one gets away with trying to embarrass me or bring me down."

Holder to Obama, "Right away, Boss."

Quick investigation results (of course these "crimes" demanded priority over the F & F/Brian Terry investigations.) /sarc

B U L L - * * * * !

And at the same time, they refuse to close the border, and seek every avenue to naturalize the illegals among us.

Lol! What a surprise, if I remember correctly Arpiao basically told the Justice Department to “go to hell” when they started this witch hunt and refused to participate or cooperate with the investigation. So you knew they were going to gunning for him because he didn’t “respect their authoritah”. Now I guess we have to wait and see if they actually have the cajones to take the next step and try to charge him with something, because I can guarantee Arpiao is not going to willingly agree to “federal oversight” which is what this was all about.

If only they had stood at voting polling place entrances with billy clubs, refusing reporters from entering. Then all would be well.

Meanwhile, Sheriff Joe is playing his cards close to his vest.

His finding or rather the posse finding will destroy the DOJ CinC and the authors of this finding will be back chasing ambulances and suing for spotted owl abuse

How is anyone supposed to believe anything from this DoJ? They’ve lost credibility a long time ago.

From the article:
“MCSO’s systematic disregard for basic constitutional protections has created a wall of distrust between the sheriff’s office and large segments of the community, which dramatically compromises the ability to protect and serve the people,” said Thomas E. Perez, Assistant Attorney General for the Civil Rights Division.
Hmmm.. a "wall of distrust." I guess that explains why Sheriff Joe has been in office since 1992, was reelected with well over 50% of the vote in 2000, 2004 and 2008 and easily beat a recall effort in 2007. Source.

The investigation, opened in June 2008, was conducted under the provisions of the Violent Crime Control and Law Enforcement Act of 1994 and Title VI of the Civil Rights Act of 1964, and the Title VI implementing regulations.

In June, 2008, George Bush was President and Alberto Gonzales was the AG. What's up with that? Why were they investigating Arpaio?

In 1994 Clinton was President, Janet Reno was AG, and Eric Holder was Deputy AG. In 1964, LBJ was President, so those laws are consistent with who they are.

We’re overrun with illegal aliens, violent gangs from Mexico and the Feds are on their side.

THIS is a gift from Obama, Holder and the Democrats. The majority of polls and opinion of American citizens is anti everything this administration is doing and they have just poured accelerant upon what most Americans want and need for the sovereignty and protection of this nation and the citizens within it.

Candidates need to use this to their advantage and those (like Trump) who get press for their opinions need to make sure this destructive agenda by democrats reaches every nook and cranny of America.

Rasmussen poll voters prefer border enforcement to amnesty by Two to One

President Obama’s recent administrative amnesty runs contrary to the public will (not to mention the Constitutional limits to Presidential power) as shown by recent polling.

Despite the media’s relentless propaganda about the bogus desirability of illegals, e.g. young aliens in student costumes demanding taxpayer-subsidized college educations, the voting public remains firm in favoring enforcement over rewards for lawbreakers.

Obama’s amnesty with work permits takes place amid the worst unemployment crisis in America since the Great Depression, and will displace citizens from scarce jobs. The amnesty sends the message to the world that even terrible suffering by Americans will not cause Washington to get serious about border and workplace enforcement. Would-be illegal aliens understand that if they make it over the porous border into the interior, they will not be deported under the Obama reign.

D0J has to get him before his group releases the Birther informtion early next year. Truth not allowed by the DOJ.
Get him and others may fade away.

I think that the U.S. Department of [In]Justice has, under the leadership of Eric Holder, has engaged in a pattern or practice of misconduct that violates the Constitution and federal law.
