MARIN COUNTY, Calif. (KGO) -- A Marin County smoking ban is on hold while lawmakers consider weeding out marijuana from the measure.
The ordinance as written would outlaw smoking in unincorporated county apartments and included marijuana and other herbs as well as tobacco.
It was abruptly sent back to committee Wednesday when Supervisor Kate Sears said only tobacco should be banned...

Marin County is one of the most liberal and least tolerant counties in all of California. I have to work in that “progressive” cesspool nearly 5 months out of the year and know from personal experience what kind of power hungry commissars populate the local political landscape....
The Supervisor said that the law shouldn’t ban pot smoking, because there is already a law doing so.
How would the seriously ill be able to smoke their medical marijuana?

When my brother had a medical practice in San Francisco
he lived in Mill Valley.(Marin county)
I visited and found it to be quite nice, but that was 40 years ago.
He now lives in Paris, but his twin lives in Pacifica, overlooking the ocean. I do not know what county that is.
Pacifica is in San Mateo county.
Why would anyone ever choose to comply with such laws? Why would you open the door to such regulations? Where will the transfat free apartments be? Or carports restricted to only vehicles that get at least 45 miles to the gallon. Oh, hey, there's the plasma tv ban in apartments... Oh, wait, let's require the power to be shut off during the day, keep those vampire appliances from eating up the power in the state.
At what point do people say ‘enough’? At what point do they blatantly go out of their way to break inane laws, and then challenge the government to actually enforce them?
Will it be when BBQing meat becomes illegal because a vegan might inhale the fumes of an animal roasting on a fire? Will it be when the police knocks on your door to find out exactly how many laws you've broken?
I don't care what anyone’s opinion is on smoking, this is regulation of private property for the sake of establishing such regulation. It doesn't matter if you find it disgusting or offensive, if you let a city or county government regulate these kinds of details of public life, you can kiss goodbye any chance of challenging them later.

Where do you think Babs Boxer lives? She moved to Marin County from New York City many moons ago and is part and parcel why Marin County is what it is!

Thanks...That is interesting, as he lived in the town of San Mateo before buying the condo in Pacifica, but it seemed to me that San Mateo was somewhat farther to the south.
I looove marijuana...but the nanny state really harshes my buzz ;^)

"Smoke-free" apartments are common these days. Though not codified into municipal law, apartment complexes with smoking prohibitions written into their leases are all everywhere these days --and not just in California.
If you are a smoker, it's getting harder and harder to find apartments that will accommodate you.
I am not really a smoker (a couple of cigars a year, usually outside in the summer) so I do not have a vested interest in this accept as an American who cares about the liberty our founding fathers fought and died to give to us.
I have no problem with an apartment owner placing restrictions in the lease contract on the activities of renters. That is a contract freely entered in to by two individuals for the mutual benefit of both.
The government has no vested interest in the contractual agreement of a renter and his landlord other than the taxes collected from either or both. The city government has no right to place such a restriction on property owners.
Red Light Cameras, Smoking Bans, EPA, ADA, Smart Meters, the list goes on and on.....

Pacifica is just south of San Francisco in San Mateo County. It’s spectacularly beautiful from Pacifica all the way down to Santa Cruz and south to Monterey & Big Sur. Nearly all of beautiful coastal California is a liberal toilet....
I would never comply with a smoking ban like this. Let them.. catch me. I will smoke in my house, my apartment, damn near anyplace I want on my own property. The only way to fight these kind of laws is to ignore them.
Just look at illegals.. how many times do we hear “You cant deport them all?”

Yes, one thing that bugs me about calling it nanny state is that that sounds sort of, annoying but for your own good, basically harmless. Tyranny is NOT harmless, no matter WHAT face it dons to weasel its way into a society. These people should be SHUNNED in all cases, imprisoned in others, where they have clearly gone too far.

Interesting dynamic, since apartments are inhabited by POOR people, who have much more tendency to smoke cigarettes than RICH people who can afford houses. It’s literally a war on the poor. But who ever accused liberals of being consistent or logical, or even possessing a brain?
Shelion (RIP) had a list of violent incidents that had taken place over someone using tobacco. It was a long list. These laws are like permission to attack to the pharisee class.
I don’t think they allow poor people in Marin County, except as household servants of course. Maybe low caste retail jobs.
