Crime Victim In MA? No Self Defense, Just "Call Cops, Hope They Show Up Fast"
Boston Herald ^ | January 13, 2012 | Michael Graham

Posted on 01/13/2012 5:28:04 AM PST by suspects

Here’s the final outcome of the Anthony McKay case:

If you defend your family and property from a knife-wielding druggie in Massachusetts, you’d better be prepared to also defend yourself from the justice system, too.

McKay is the young father who, seeing a local druggie breaking into his truck and stealing the tools he uses to pay the bills, confronted him, subdued him and held him for the police. When the police arrived, they found the bad guy had a knife, a billy club and — thanks to the unarmed McKay — a broken jaw.

Instead of thanking McKay for helping get an armed criminal off the streets, Swampscott officials charged him with a felony. As a Swampscott police spokesman said at the time, “We don’t urge anybody to fight back. We want them to call us.”

Thanks to pressure from readers of the Boston Herald and others, McKay will not be prosecuted. But the Essex County District Attorney’s office has made it clear that they are not supporting your right to self defense.

The Lynn Daily Item yesterday reported that the Essex DA insists the decision to nol pros — decline to prosecute — the case does not mean they think the police were wrong in arresting McKay. “It was not meant to Monday morning quarterback,” said spokesperson Carrie Kimball Monahan.

McKay’s pro bono attorney, Richard Chambers, was told the same thing. “The Essex DA’s office said they are able to prosecute some cases and not others, and this is one of those that they are not going to prosecute.”

In other words, McKay is lucky that the media made an issue out of this outrageous prosecution. Otherwise he could have spent five years in prison instead of working and paying the bills for his three young children.

Who...

Dumbest thing this guy ever heard. Cops here will offically tell you dont fight back but off the record will tell you to do what you can to defend yourself{Including buying a handgun, but thats really off the record}.
I guess there is a big difference between small town barny fifes and real cops who knows what the real world is all about.

“We don’t urge anybody to fight back. We want them to call us.”

A microcosm of the leftist/communist mindset - you will obtain and achieve nothing unless you go through us, the party. Providing for yourself is against this overarching law.

And the moron Republican voters want to elect the former governor of this $hitthole state!!! Lot’s of you want to “cut California loose from the rest of the country.” To all of you I say, try it with Massachusetts first, it’s much worse than California (actually beyond hope) and its much smaller so the cutting would not take as long.

Massholes at work. The reason that the Peoples' Democracy of MA is such a wreched police state is that the MAJORITY of the people who live there WANT IT THAT WAY.

The politicians who hire the arrogant bureaucrats who direct the goons in blue are selected by a majority vote of the people. Sure, SOME people were outraged, but I bet this sort of behavior on the part of the government doesn't change a single vote in one of the most anti-gun, and in this case obviously anti-self defense states in the US. If you live in MA, STAY THERE. Don't move to FL or GA and bring your jackboot licking ways with you (And this applied to New Yorkers too.)

There’s a lot of space between “We don’t urge anybody to fight back” and charging someone with a felony for doing so.

I live in a small town in W PA and know all the cops and to a person, they will tell you to defend yourself and make sure the perp is "secure and harmless" before you waste time calling 911.

How you secure and make the felon harmless is up to you.

If all of my guns hadn't gone down in the great canoe sink, in an unknown deep lake, I'd use one of them, but alas, I'll just have to depend on one of the borrowed guns that may be handy.

And throw NY in too. Give them both to Quebec.

Are off duty police allowed to defend their home or property? or should they wait for the authorities too?

Gosh I wish we once again had sane people in positions of authority, instead of the loser/idiots we have now.

Ya, wait for the cops. I did that this weekend at 3am when a drugged up nut tried to enter my home. Took them 40+ minutes to arrive. Fortunately, the dog ran him over the fence(he’s proud of himself) and I was ready if the punk came back for more. He tried to get into a fight with us, and the guy was going up and down the street picking fights (verbal) with others, then disappeared before Crispy cream On Patrol arrived.
They treated it as a simple trespass, ignoring the threat of violence this nut represented.

If cops don’t show in time it’s your fault.

You did not insist and fight for more cops.

It’s common knowledge in Texas that if a burglar breaks into your home, shoot to KILL. You won’t get in trouble with the law and the scumbag can’t sue you.

Your statement must be satire.

At least I hope it is.

When seconds count the police are minutes away.

Massachusetts is becoming more like the UK every day.

Clearly if you have enough to make you a target in MA and not enough to have your own body guard, you are an irritation to the collective and thinning this part of the herd is a good thing. They might advance to the body guard rank and that could cause crowding. Harming the predators could reduce libtard voters.

You need to tell dispatch there was something in his pocket and your not sure
if it's a knife or a gun, then hang up. Just don't go outside when
they show up or they'll put you in cuffs too.

We have the same protection here in Pennsylvania where we recently passed a Castle law that lets us stand our ground and protects us against lawsuits from an injured/dead perp or his family.

Actually, that would have been too blatent a lie, since he didn’t have pockets, or clothing of any sort. I’m surprised the dog didn’t get sausage and eggs for breakfast.
I’m now looking at upgrading my firepower beyond a simple .38.

You mean, the one you took from the now dead assailant after distracting him by begging, trembling and dropping your wallet? Which has no prints on the cartriges and only your prints on the exterior?

I would never taking any canoeing.... but... well when I moved to Forida I did not realize how bad the heat, humidity and termites could get. I left all mine in a closet and a few weeks later when I checked on them all I found was a pile of rust, splinters and melted plastic. Such a tragic mistake.

Liberal judges have been making this kind of decision on their own everywhere for years. I was driving a cab nights in the 90's and my fare struck me in the head from behind as I was making change from a bank bag. We wrestled over the bag, I broke his wrist and he fled. I pursued him into the snow and pounded him. The police arrested ME for felony A&B and I was convicted. According to the judge, he never got the bag so no robbery took place, and I pursued him when I should have run away screaming for the police and waving my arms hysterically. I avoided jail, paid about four grand between a fine and his medical bills.

Meanwhile I had a clean record that is screwed for life...no abatement in that state. My assailant had already been in jail for domestic abuse and bad checks, and went to jail for burglary before I moved on. If you refuse to be a victim, they will make you a criminal too.

I still would've pounded the bastard. I just would have lied my ass off about it later. Telling the truth to police...what an idiot I was.

It’s common knowledge in Texas that if a burglar breaks into your home, shoot to KILL.

If you have to pull a gun, you had better be trained and committed to using it, and by definition that means, shoot to kill.

The Lone Ranger, using silver bullets and shooting the bad guy in the gun hand is a great old time TV story, but that's all that it is.

Just remember, Mr. Policeman: When seconds count, the cops are [many] minutes away. Call Mr. Colt or Smith&Wesson and then call 911.

Want to change this mindset? Take away HIS firearm [and in the case of officials, taxpayer paid security], then let them navigate the real world like everyone else. I guarantee they will have an epiphany (or be dead).
