RICHMOND, Va. (WTVR) - Federal District Court Judge John Gibney ruled against Texas Governor Rick Perry and other Republican presidential candidates who sued in an effort to appear on the ballot for the Virginia Republican primary in March.
Judge Gibney announced the ruling Friday afternoon in Richmond, Virginia.[CLICK HERE: Read the judge's order] The suit was originally filed by Texas Governor Rick Perry.
Newt Gingrich, Rick Santorum, and Jon Hunstman later joined the challenge.
According to court documents, the Republican candidates failed to meet the 10,000 signature petition requirements to get on the ballot.
Mitt Romney and Ron Paul met the requirements.
Monday, Judge Gibney ordered the distribution of absentee ballots for Virginia's Republican primary to be halted until the legal challenge could be settled.
Judge’s ruling here: http://media.trb.com/media/acrobat/2012-01/340069800-13125153.pdf
Mitt Romney and Ron Paul did not have to abide
by the nunc pro tunc “requirements”.
The judge is obviously a partisan Willard supporter.
I think an appeal is in order.
WOW! The fix is raally in.
If it stands.. I suggest you support Ru Paul to stop the mit machine.
aother Rockefeller win
It does not happen very often, but sometimes a judge will rule on a case and consider States’ Rights’ and the 10th Amendment.
This is of course opposed to all those liberal activist judges who seek to interfere in the right of a state to hold elections as they see fit.
The Wall Street Journal now asks......It’s not a matter of Newt losing. It’s a matter of will he lose with dignity. Newt, Perry, Huntsman showed their true colors. Win at any cost.
Gotta give to Santorum, he didn’t go there.
I thought Perry’s implosion was historic. I Now have to say Newt’s was even more so. We gave him a 2nd chance. We chose not to listen to what everyone was saying about him, his ego, his temper, his arrogance. I liked him in the debates, I liked him with the press.
Then he decided to go kamakazee and attack free market capitalism and he’s taking down the party with him. When in fact, like the kamakazee pilot who missed the ship and hit only the water......Newt and the others are hitting only water and destroying only themselves.
I’m no fan of Romney, in fact I couldnt stand him before. But he’s grown on me, he’s unflappable, he’s Presidential, he’s not perfect, but he seems to have become more conservative in the last few weeks, his speeches are great.
It’s time we all rally around him. It’s time.
No they both had a lot more than required, one had almost 15,000 and the other almost 20000.
You really think it is going to happen here?
And that's on his good days.
They are waving the red flag at us in this one ~
One solution to this is for Romney and Paul to decline to run in Virginia until such time as the State Legislature can figure out which end of their nether regions runs their mouth.
NEVER...NO ROMNEY...NO WAY...HOW CAN WE LET TWO little STATES DETERMINE OUR CANDIDATE...
I hate this process...
Sorry, FRiend. The posts here previously indicated
that were not bound by the “requirements”.
If you have proof to the contrary, post it.
NO! you still have the write in option.
Just conduct a write in effort.
The last person you want to vote for is kook paul.
Why would they do THAT? Paul and Romney
both are financed by Soros who set this up.
Judge Gibney: “The residency issue is likely to fall in the appellate court, but I cant see how I can put them on the ballot without the 10,000 signatures.”
I should support a lunatic over a liberal liar. Amusing.
He didn’t attack free-market capitalism, he attacked Mitt Romney. Romney is a big government statist CRONY capitalist. Capitalize the profits, socialize the losses.
Just giving you the raw numbers, the republican review committee said the number exceeded the need for audit, take it up with them.
Do you favor a federal court’s intervention into a state’s right to hold elections in a certain manner or do you believe that a state should be able to conduct elections without an unelected activist federal judge overruling decisions of a state legislature?
Obama appointed Judge
Too bad for Perry that he didn’t get one of those activist judges on the case.
Jim, I appreciate your forum here more than you will ever know and I respect you. But have you listened to Romney’s words lately? I was no fan of his but he has shown me something of late.
In his speeches, in the debates, he’s articulate, unflappable, not perfect, no not perfect by any means. But he handles pressure and attacks, and even when Newt and Perry out and out LIE about him......as they did when they took his comments about “firing people” completely out of context.
I agree with Dennis Prager who has not lost all respect for Newt and Perry and Hunstman.......the headline should have read.......”Perry’s attackers LIE about what he said.” And they did....and they know they lied. “win at any cost”....that is their goal. And it’s a shame.
That, dogz, is a very good question.
In this case I believe the Feds shouldn’t be involved, as it isn’t an election for national office, merely a state primary to see which contestant gets to run in the national race.
I said the fix was in because it is so obvious the RNC was involved up to its ears in this one.
Damn the Establishment!
Canada is looking pretty good about now. Costa Rica is too hot for me.
Rally around a pro-abortionist with blood on his hands? Rally around a sodomite lover? Rally around a phony, conservative hating weakling?
the “not” should be “now”.......Prager is the best I hear everyday too.
I hear lots of whining, but no ORGANIZING.
Are you going to South Carolina to work for the campaign for your candidate next week?
How many phone calls did you make in to South Carolina for your candidate today?
How many mailers did you print and mail for your candidate today?
How many Tweets did you create for your Candidate today?
How many Facebook postings supporting your candidate did you make today?
This is the process. We ALL knew it.
Here in Virginia there is no write-in option for primaries.
As another poster said, the fix is in.
Life imitating art. Except in this case, it's a choice between "marshmellow fluff" and the crotchety, old shop instructor who never quite made it out of the 60's.
You leave me speechless, otherwise I’m going to say something that will get me kicked off this forum.
If this is not overturned, I will campaign and vote for Ron Paul in the primary. This is awful. Flame away.
Romney is a lying political whore who will do or say whatever he thinks he has to do or say to get elected.
Watch it all the way through. It’s a compilation of a couple dozen of his debates and appearances. The man has no bedrock principles. No core values. And he lies about anything and everything.
No thanks!! NO SALE!! NO ROMNEY!!
The ruling isn’t based on States’ Rights, but on the equitable doctrine of laches — essentially, that the plaintiffs should have filed suit as soon as they entered the race last summer.
He specifically says that they would have been entitled to the relief sought had they filed sooner.
"Come on. Big village. Be quick. Bring PACs.
(signed) Mitt Romney"
He's a slick, double-talking, backstabbing socialist.
A pox on him.
“But have you listened to Romneys words lately? I was no fan of his but he has shown me something of late.”
LOL, are you serious? Romney’s words mean nothing—he has been on both sides of every issue. Who in the world could believe anything he says?
C’mon. He’s the father of RomneyCare and grandfather of ObamaCare! And he still brags about it as a “free-market” solution today!
Give me a fricken break already.
Any Presidential Candidate who was not smart enough to have their Staff do a “Google” search to figure out what they needed to do is not a Candidate I want in the running for President of The United States.
“In his opinion, Judge Gibney wrote, “They [the candidates hoping to appear on the ballot] knew the rules in Virginia many months ago; the limitations on circulators affected them as soon as they began to circulate petitions. The plaintiffs could have challenged the Virginia law at that time. Instead, they waited until after the time to gather petitions had ended and they had lost the political battle to be on the ballot; then on the eve of the printing of absentee ballots, they decided to challenge Virginia’s laws.”
Too Bad. So Sad. That is Personal Responsibility which comes with Freedom.
RPV rules say NO WRITE-INs will be counted.
But hes grown on me, hes unflappable, hes Presidential. ..his speeches are great.
Its time we all rally around him. Its time.
