AMERICAN FORK, Utah An American Fork man says his right to bear arms was violated after police stopped and cited him for disorderly conduct.
Spencer Bergon is a manager at Walmart. He was getting ready to go target shooting with a friend and, while waiting for his ride, he took his guns out of his car to put them in their carrying cases. At the same time a woman walked by and got scared.
Bergon says the woman came back and circled him in her car at least five times. He says he knew she was calling the police. Bergon says he left the area but was stopped by police in a church parking lot. He was then interrogated for two hours and cited for disorderly conduct a ticket, he says, that will cost him hundreds of dollars.
Bergon says his rights were violated and, although he does not have a concealed weapons permit, in Utah, residents are allowed to carry guns without a permit as long as they are in plain sight. He says the ticket is unfair.
I don't blame them for taking the precaution that they did, Bergon says of police. They were very kind and respectful. What I don't understand is why I would get a ticket for having my legal rights to carry a firearm.
Bergon also says he does not blame the woman who called police, saying he understands why she was concerned.
Police initially got a report from the woman saying that she thought Bergon was following her.
During our investigation we found that was nowhere near the case, said American Fork Police Sgt. Gregg Ludlow.
Police gave no real explanation on the ticket as to why he was cited for disorderly conduct.
Bergon has no criminal record and plans to fight the ticket in court.
He’s wayyy too understanding.
We had the same trouble here in Wis. until law suits and a change in the law solved it.
The woman sounds like a meddling b-tch.She claims she was afraid,but circled back at least 5 times?Then she falsely claims that he was following her?
Cop #1: Those your guns?
Citizen: Yep.
Cop #2: You got a permit for them?
Citizen: Yep.
Cop #1: Where you going with ‘em?
Citizen: Shooting range.
Cop #2 to Cop #1: Aw hell, we missed out on the last jelley donuts at Winchell’s because of this. Now, we can’t shoot him, can’t arrest him, can’t confiscate his weapons and there ain’t no more jelley donuts! This sucks!
Cop #1 to Cop #2: Well, we can always cite him for “disorderly conduct”.
Cop #2 to Cop #1: Yeah. Great idea. Cover me while I go back to the squad car and fetch my citation book. If he makes any sudden moves, fill him full of lead.
Even though a state, in my case NC, has “open carry” if someone calls the police on you they generally will charge you with “causing panic”. It seems it’s the police catchall here.

You are absolutely correct. It is a catch-all.
1) Who was the “woman” related or otherwise connected to? 2) “Disorderly conduct”? What are the citeria? What “conduct”? 3) The “woman” circled several times? Sounds like stalking to me.... 4) The
Barney” that wrote the citation needs to be FIRED and charged with the stiffest thing possible. 5) Did the gentleman calmly tell Barney “I request that you now call your supervisor to come to this location immiediately”? 6) This whole thing sounds SO absurd that it is nearly unbelievable.
back in 19 and 66, I was waiting at a friends apartment, in my car, on the shoulder near a busy intersection that contained the apartment complex, a bank, and a police station....
we were going clay bird shooting and I had the skeet machine in the trunk...the back of the car was bristling with uncased shotguns sticking straight up....and I, bored to tears, waiting for my friends (2 brothers). I picked up another friend’s(he was sitting next to me) pair of binoculars and was glassing the rears of various females that were entering the bank....
....WHAM! 3 unmarked cars screetched and blocked me in....they yanked me and Dwayne(not his real name) out of the car and we were made to assume the possitions as I tried to explain that we were going skeet shooting....
I opened the trunk, which contained another shotgun, a skeet machine and a couple of cases of clay birds...
....as that was going on, the 2 brothers exited their apartment with shotguns in the crook of their arms...
the cop cautioned us and let us go....
it seems someone called the cops as they assumed I was casing the bank with the glasses....and saw the shotguns sticking up in the back seat....
today if it happened I would probably have been arrested for
glassing the lasses....and more specifially their ***es.
Any woman that passes by a weapon 5 times isn’t scared.
She is just plain nosy, and a busybody.

Probably figures he has to be to avoid far greater problems than he already has. That which “could never happen in America” and was only feared by kooky conspiracy theorists is now happening all around us, only the idiots don’t realize it yet.
Circling him 5 times!?! Hell he should file a stalking complaint against her.
Five’ll getcha ten the circling woman is a gun hating liberal.
That they can ruin your day like that is the reason I got a permit to carry here in Pennsylvania. A goofy cop can make your life miserable when transporting a gun to the gun club, but not if you have a permit to carry.
Things are slowly changing for the better but it is a up hill battle.
This short storie is more like the direction we are sadly headed.

Since she circled him 5 times he should charge her with stalking. Just another liberal goof ball, which should come with a price tag.
