F ROM D RED S COTT TO B ARACK O BAMA : T HE E BB AND F LOW OF R ACE J URISPRUDENCE Charles J. Ogletree, Jr. 1 I NTRODUCTION The Harvard Law School Blackletter Law Journal, affectionatelyknown as BLJ, celebrates its 25th anniversary this year. The BLJ has muchto celebrate. During its life span, Harvard Law School and the country asa whole have made great strides in advancing civil rights and racialequality. During this past monumental year alone, Barack Obama, aHarvard Law School graduate and the first African American Presidentof the prestigious Harvard Law Review, became the 44th President of theUnited States and the first African American to be elected to the nationshighest office. President Obama has appointed Eric Holder as the firstAfrican American Attorney General of the United States, as well as ElenaKagan, the first woman to serve as Dean of Harvard Law School, as thefirst female Solicitor General of the United States. BLJ has been an impor-tant part of this national transformation.Yet, for all of the progress achieved, I am not persuaded that, as somehave argued, we have entered into a post-racial America. Rather, inthis foreword, written in honor of BLSs 25th anniversary, I hope to illus-trate how, over the last 150 years, progress in advancing racial equality inthe United States has ebbed and flowed. All too often, significant forwardmotion is followed by a dramatic backward lurch. This pattern is particu-larly evident when examining major legal decisions pertaining to racerendered by the Supreme Court since the Dred Scott decision of 1857.Each decision, along with related developments and events that shapedour nations discourse and attitudes about race, provides us with a foun-dation upon which to develop a strategy for addressing racial diversityand jurisprudence in the

“How about all Americans have equal opportunity.”
This is about redistribution of wealth, not opportunity.
This is probably old news but this story illustrates the growing racial divide facing us.
I never heard of Black Liberation Theology or Critical Race Theory before Obama.
I now know the fruits of these trees.
The age of Obama- is just vengeance for sins they never personally suffered against people who never committed them.
“This is about redistribution of wealth, not opportunity.”
I disagree with you, buddy.
We’re changing the conversation from left wing crap about commie redistribution to free enterprise equal opportunity.

The constitutional Repbulic established by the white “racist” founders is said to be the system of white racism that must be conquered. In addition the white racists who cling to this racist system must be, ultimately, eliminated.
Along the way, conservatives argue against the inane arguments the Left offers for this Marxist movement based upon race/class hate and race/class jealously. We argue against quotas and for merit. We argue against race based legal system and for equality before the law without regard to one’s race. We argue against immorality and for the family as a basic social structure of our society. We expose anti-white history revisionism and propaganda. We beat the left when we argue for our constitutional Republic, but only among whites. Blacks, and as time goes by, more and more Hispanics are anchored into the Left’s traumatic race hate education and cause.
We have to take out the left from running our educational institutions and REPLACE it with constitutional Republic social and economic ideology and values. The constitution is the law of the land; Marxism (the solutions of the Left to conquer whitey) is illegal in the United States.
