S.C. bill would remove 'stand your ground' defense

COLUMBIA, S.C. — A newly proposed bill in South Carolina would remove a legal protection giving people the right to use deadly force.

Denmark Rep. Bakari Sellers said today he wants to remove the "stand your ground" provision from the state law that deals with personal property protections. Sellers' bill would strike language saying someone who isn't breaking the law and is somewhere he has the right to be, like where he works, has the right to use deadly force to protect himself or someone else.

The provision became law in 2006.

Sellers says he was inspired to introduce the bill after the death of Treyvon Martin. The black Florida teenager was shot to death by a Hispanic neighborhood watch captain who has not been charged and said he shot in self-defense.

I really thing there’s an extent in which deadly force is okay. People shouldn’t get in fist fights and shoot each other...but I guess the devil’s in the details and how it works in the court system.

I agree. That’s why the laws are worded “reasonably threatened” when describing the circumstances that you can use self defense.

What an asshole.

The idea that we are PASSIONATE about eliminating "bullying" in Schools, but we want criminals to have their way with the populace, by disarming them?

I believe the elimination of repeat offenders under the "Stand Your Ground" provisions in Laws today are reducing the crime rate, dramatically, and "Holder's People" are scared shitless.

Are the “stand your ground” laws materially different than the older “no retreat rule?” I have not paid that much attention.

For a very similar case to this one but with the races reversed, google David James, white vet, killed by black retiree, Trevor Dooley in September 2010. Dooley, even though he initiated the confrontation, was not charged in the killing of James.

Actually, I believe the silent majority of law abiding Black Americans support Stand Your Ground. They want the right to defend themselves against gang members and other thugs and criminals.

It is the “community organizers”, “activists” and politicians who want to make all Americans of all backgrounds easy targets for violent criminals.

No, he doesn’t want to disarm them, he just wants criminals or their families, to be able to sue a victim who shoots a criminal. And also allow the DA and courts not to have to start with a legal presumption the victim is justified in using their weapon and that they’d have to prove they weren’t.

This is straight pandering to his constituency in a desperate quest to be seen as the next Obama. Ugh.

Umm, they are not that big of a minority if you know the stats of arrest in the black community. But yes, I agree that law abiding blacks support it to, even though they would never come under the same scrutiny for shooting a black criminal like a white victim would. For that reason I wish they would not be so silent on the issue.

He is currently the second youngest member of the South Carolina General Assembly following the election of Boyd Brown from Fairfield County in 2008.

Is it just me, or does it seem to be crazy to base public policy on a few selected incidences?

Why are they jumping the gun to change the law based on a sample size of one?
