Agreed, although I would add that underestimating the Supreme Court’s ability to accrete power was another error. The English Commonlaw system had not prepared them for a juridical super legislature.

Or as Andrew Jackson supposedly said:
"John Marshall has made his decision; now let him enforce it!".
I think the Supremes had their decision made for them. This is all "window dressing".
