We are told that it is up to the Supreme Court to determine what laws are constitutional, but that is hardly in line with the limiting principles offered by the U.S. Constitution. That power the courts claim to have is called Judicial Review, and it is addressed nowhere in the Constitution. In fact, the federal courts seized that power for themselves through an opinion written by Justice John Marshall in the Marbury v. Madison case of 1803.
Yes, thats right, the courts gave that power to themselves.
By deciding if laws are constitutional, and since the Supreme Court is a part of the federal government, what is happening is that the federal government is deciding for itself what its own Constitutional authorities are. That, my friends, is hardly in line with the original intent of the Founding Fathers.

The SC renders an “opinion”, which may or may not be accepted or rejected, but by whom is the question.
We have need of a final, but always constitutional authority.
But, when “up” means “down”, in this strange and divisive era, the Constitution can not stand, under the myriad of opposing definitions.
A careful reading of Madison’s Notes, the Federalist Papers, and other original sources shows that it was assumed that the Supreme Court would have the power to explicate and defend the Constitution.

If the Supreme Court fails us, we can call a Constitutional convention and re-define the relationship between the federal government and the States in any way that meets with sufficient approval of those states.
The number of states that have moved to protect their citizens from ObamaCare (tm) are just a few short of the number required to convene a Constitutional convention. So, it will not take too much additional alarm to provoke the next level of peaceful response within the current frameworks.
I used to be concerned about what such a Convention might do. My first response is that any changes that the Convention passes will have to survive the ratification process with all the States. The second is that ObamaCare (tm) destroys any remaining limits on the power of the federal government.
Here is how the Amicus brief by the Institute for Justice concluded:
“If the individual mandate of PPACA is upheld,
the power to regulate commerce will include the
power to compel it. This massive new federal power
would soon overtake the entirety of the states residual
police power, including the entirety of contract
law, enabling the federal government to eviscerate
hundreds of years of basic understandings of the voluntary
essence of legally binding contracts.
“Equally important, from the perspective of individual
liberty, a power to compel contractual relations
would have no logical stopping point. It would presumably
include, for example, the power to compel
individuals to buy any good or service not just
health insurance so long as Congress could rationally
conclude the market for that product would benefit
from forced purchasing. It would also presumably
include a power to compel individuals to work for
specific employers or in specific occupations, so long
as Congress could rationally conclude that those industries
or occupations would benefit from such forced
contractual relationships. When combined with the
Courts highly deferential standard of review for exercises

the very Leviathan government the Founders spilled
their blood to resist.”
In light of this, a Convention is the lesser of two evils.

A loaded question.
But, consider what must happen without one.
Conservatives and “traditional” (i.e., mostly “Euro”) Americans would like nothing more than to be left alone to go their own way. Conservatives probably don’t care how the left lives in the parts of the country that the left controls, so long as they are left free to live a life in which traditional ways are preserved and “old ways” are recognized and respected. “Live and let live”. I daresay that conservatives and traditionalists would be content with a “peaceful separation” from the left, yet would be willing to negotiate with the other side so that a mutually-beneficial co-existence could be maintained afterwards.
The left, however, can never permit this. They demand that everyone behave in accordance with their diktats, and will not be satisfied until all are brought to bear under the boot of their authority. They will use whatever government power is required, including unleashing the miitary and militarized police against ordinary Americans to force compliance upon them. The only persuasion that will make them stop will be by force of resistance.
Conservatives must understand (and I’m sure that those who are “conservative-realists” do) that the left has used the preceding five decades to infiltrate all levels of the power structure, and has used Gramsci-an techniques to spread their tentacles beneath the surface of the American consciousness (particularly with leftist-leaning inculcation of kids in public schools). For that reason, the “divide” between the left and the right has turned from a wide valley into an unbridgeable chasm. With them, there can be no compromise, no turning back from the course they have chosen.
As conservatives see the nation pulled ever-leftward, we must be wise enough to realize that to continue to cling to the notion of an America with the ideological “room for all” will lead us nowhere, because the left has no qualms about crushing conservative ideals out of existence. To maintain a national status quo is to accept defeat, and submit to the left.

You stated my thoughts as well. We have a Cold Civil War going between us and the left of the last 30/50 years but since the 2000 election, it has gotten more intense. Yes, I don’t like what the New Dealers did, but at least they did not hate their country like the current crop does today. That’s the difference between the old and new lefts so to speak. I keep thinking that we are in an 1859/60 country in a 1939 world. AS you pointed out, both sides are 180 degrees out of phase with each other.
I tuned on Leftist talk Radio on Friday, the Mike Malloy show. He seriously was saying the Supreme Court is now illegitimate and should be done away with, because 9 people should never be able to overturn law passed by congress. He also advocated another civil war, but this time kicking bumpkin land as he called it out of the Union, referring of course to the red states. This is how sick and twisted and dangerous the left has got.
IF it comes down to revolution, the leftists are in a heap of trouble. They are so used to court decisions and paper abuses that a REAL fight would overwhelm them. Violence will end their reign, I can almost assuredly say.

We could end up a monarchy ... it would depend on who had the guns during the decision-making.
It sounds good but it will be like juggling hand grenades with no pins.
We would be better off using the current constitution to remove the current congress, court and executive using a consortium of county sheriff’s.
The County sheriff is the highest law enforcement in the state (power over the governor and attorney general) ... any county sheriff can remove one or more bad apples.
A collection of sheriff’s from each state working together would have legal power to remove the corrupt bunch we have allowed to grow there in DC (and it could be done peaceably).
(I am not sure how likely the peaceably part is but it would be legal).
A few factual error such as the Bill of rights were proposes by the first congress as a concession to the ain’t-federalist, not the states.
To date no 2nd Constitutional convention has ever been called. the 750+ calls for such a convention by 49 of the 50 States have all fallen upon Congresses apathetic ears.
If there is to be a 2nd convention it is likely our States will have to organized it themselves. The author is probably right Washington has little to no interest in entertaining a convention and indeed might even try to call the one organized by our States illegitimate.
This is about power taking the amendment process out of their hands is the greatest possible non-military threat to their power.
What ever our needed methoid of reclaiming our libertgy, restassured Control of our state goverments is THE MOST essentially political assets we have in that fight.
With our State Governments we have the means to practically control:
2: Elections(including but not limited to distracting)
3: Constitutional Conventions
4: The only realistic potential to raise a patriot army to stand up to Washington.
5: The only realistic potential to nully and effectively interpose against Washington’s transgressions against our rights.
Simply put we cannot hope to wage, or win a revolution without control of our State Government. They must be our #1 electoral priority! They are also the only tool that politically can be convinced to stand up to Washington’s power in the interest of advancing their own. The truth is under a government as vast as the U.S. Federal government have no prayer of resistance or reformation without our State governments.
Focus all electoral energies on taking more control of our State governments! Congress and the presidency are secondary objectives of somewhat limited & short term consequence. Long term we MUST have control of our State Governments!

This is true, but nothing that happens there can have any consequence without the ratification of 3/4th or in the case of a new constitution every state that is to be apart.
To be frank I feel a lot more uneasy about Washington Politicians in Congress proposing amendments. They almost always seem to want primarily more power for themselves in Washington.

If you mean Gun’s you will find most of them in OUR not THEIR hands. I’m not sure what other kind of Gun’s your talking about. Our States outnumber theirs, in a form in which we are equals we have the uperhand.
If the SCOTUS rules DeathCare constitutional, there is no more Union. It will be a totalitarian regime, not seen since the USSR and rivaling Red China. Should the Union be dissolved, there will be two choices: freedom or slavery.
Ironic, isn't it? One hundred and fifty-one years ago, we had a President from Illinois who started a war to end slavery. Today, we have a President from Illinois who wages war on the nation to make us all slaves.

Perhaps. Where will THEIR army come from? Do you think the leftists will actually fight? Or, will they unleash the hoards of dregs of society that they have created and then stand back watching? Personally, I don't care. I am here, awake at 6 am praying and worrying about the kind of world my young sons are going to grow up in. The wealthy don't care. They think they are protected from what's coming. They believe they will always have just enough cash to keep the barbarians at the gate.
There is too great a population that looks to the feds/left for sustenance. The left will portray us (as they have in the past) as taking food from their mouths when the money dries up.
We are no longer, by any stretch of the imagination, a free country anymore. Sure, there are some who can still afford whatever the want but the vast majority of us are being overwhelmed by boot of this govt.
That we are dependent on nine people to govern us is proof we are doomed. Unless we stand up as a whole and say, "We demand our freedoms back!" I don't believe that will ever happen. I weep for the future of my children.

Nothing can be finally passed into law until sufficient states ratify it. And with the large number of states passing various laws to refute ObamaCare, this demonstrates their temperament as to any Convention. Let me point out once again that the number of states that have weighed against ObamaCare is almost as many as are required to call for a Convention.
ObamaCare is ALREADY law unless struck down by the Supreme Court or rendered moot by being defunded by the House. ObamaCare DOES NOW destroy the enumerated powers for it is certain that once government gets comfortable ordering you to buy this insurance, it is only a matter of time before they order you to buy something else. And as the IJ amicus brief states, by logic, that police power will eventually extend to ordering wages and employment. In short ObamaCare is the direct road to SOCIALISM. In my mind this is a far greater threat than a Convention passing some provision that could not survive ratification by sufficient states.
The Supreme Court was to decide what constitutional for the other branches of the federal government, not what is constitutional for the States.

That has nothing to do with the argument here - that the states have the choice of whether or not to follow the SC as apposed to deciding for themselves.
According to the argument presented here, that would be the states.

I agree with you. The Republican candidate is being chosen for us. I don't know if the source is rigged voting machines, crossover Democrats or phantom voters but something is not kosher.

We deal with the near certainty of the willingness of Obama & Company to first reject and then move around the finality of the infallibile, declaring it quite fallible. :)
In a matter of the SC “rendering but an opinion”, Obama may have a different one and act upon it.
Our country’s biggest problem, REALLY, is in the discussion factor. We are a lot bigger in geography and population than in the Founders’ times.
The main way information is disseminated is still Mainstream Media, which is wholly biased toward liberalism and statism.
The government is supposed to belong to the People. The People are informed by the Media. They are still the ultimate authority to MOST of the population, even though freedom lovers now have alternatives that are faster and better.
Most education is owned by the liberals as well, at all levels.
Therefore our national discussion is framed by a liberal perspective. Iraq war is bad, Obama is a just, eligible President, Trayvon Martin is an angel. Despite all kinds of evidence to the contrary.
This is far worse than the Supreme Court’s capriciousness, because good, honest discussion could lead to a bad justice’s impeachment, under pressure from the BOSS (the American people).
The mainstream media is our worst problem. It takes seconds for radio, TV, and the internet to be flooded with THEIR STORY. It takes another second for them to MASSIVELY discredit our rebuttal, no matter how true.
The line of thinking — nullification — is simply unworkable because it would permit states to opt out of the Constitution when they pleased.
That would frequently defeat the point of the jurisdiction that the Constitution grants to the Supreme Court.
The problem with that is what, exactly?
How about: the US of A is either a single country or fifty countries.
I get it about the number of states that have to agree.
My point is that it will be pretty hard to keep the convention to a particular agenda and those who wish to destroy us will be out in force.
They will never have a better opportunity to ‘re-make’ America as they wish.
Those who assume ‘We’ have more guns are correct on the surface but don’t forget that a situation like a constitutional convention is very rare.

Agreed, but whatever Loony Tunes that take place must be ratified by the States and given the number of states that oppose ObamaCare, the number of states that have recently passed expanded 2A rights, and the number of States that have done a lot of conservative things, the speculative risk of Loony Tunes is now FAR LESS than the real risks of ObamaCare (tm).
