Obama warns 'unelected' Supreme Court against striking down health law

**I think Obama, in his post-summit (Mexico, US, Canada) TV appearance, just told the US Supreme Court how to vote on the Obamacare issue.**

President Obama, employing his strongest language to date on the Supreme Court review of the federal health care overhaul, cautioned the court Monday against overturning the law -- while repeatedly saying he's "confident" it will be upheld. 

The president spoke at length about the case at a joint press conference with the leaders of Mexico and Canada. The president, adopting what he described as the language of conservatives who fret about judicial activism, questioned how an "unelected group of people" could overturn a law approved by Congress. 

"I'm confident that the Supreme Court will not take what would be an unprecedented, extraordinary step of overturning a law that was passed by a strong majority of a democratically elected Congress," Obama said. 

The Supreme Court spent three days hearing arguments last week in four separate challenges to the health care law, which stands as the president's signature domestic policy accomplishment. A central challenge was over the individual mandate -- the requirement that Americans buy health insurance. Critics say the mandate is unconstitutional, and that the federal government cannot force people into the insurance marketplace.

This is just a laughable statement on so many levels.

Far from being a "strong majority", the law barely squeaked though both Houses of Congress. That makes it a law passed by a "bare majority" rather than a strong majority.

And of course, any law passed by Congress necessarily was passed by a "majority", so Obama's statement really comes down to saying that it is "unprecedented" that SCOTUS overturn a law passed by Congress.

What a maroon.

I hope he keeps throwing a tantrum in the press about it for another month. Perhaps he will piss off the two that wanted to uphold the law.

I hope he gets a landmark ruling that shuts down the overreaching activities of Congress and the whitehouse using the commerce clause.

President Barack Obama voiced confidence Monday that the Supreme Court will uphold his health care law in his first public remarks on the issue since the three days of oral arguments last week.

Obama suggested that the high court would be guilty of “judicial activism” if it overturned the law, and stressed that he believed the justices would see the individual mandate as an integral part of the law.

“We are confident that this will be upheld because it should be upheld,” Obama said at a joint news conference with Canadian Prime Minister Stephen Harper and Mexican President Felipe Calderon.

“The reason is because in accordance with precedent out there, it’s constitutional,” Obama said. “That’s not just my opinion, by the way. That’s the opinion of legal experts across the ideological spectrum, including two very conservative appellate court justices who said this wasn’t even a close case.”

If memory serves, obama castigated the Justices pretty good at his first SOTU speech...maybe they have some long memories, especially now that he's doing it again.

Thanks for the link, mojitojoe. So, 0’b0z0 has *slapped* SCOTUS once again. By his standards, congress should be able to pass a law (because they were democratically elected) that every other child born must go to live in kenya because we have too many people here and SCOTUS can’t do anything because they were unelected. So why was he so excited to appoint two nitwits? Why are they there? He is beyond being a putz. If I said what I really want to call him I’d be banned.

Has he not studied the balance of powers and how it was intended for the SCOTUS to stop over reach by Congress? (Of course he has).

Eventually, through some obscure rule and perhaps rule bending, Peelousy "deemed" it to have passed the House.

He is not the first to attack the legitimacy of the Court. Long before FDR tried to pack the Court, President Andrew Jackson is supposed to have said: “John Marshall has made his decision; now let him enforce it!”.

Jackson, the first Democrat according to most, relocated the Cherokee in spite of the Marshall Court decisions. A populist demagogue screwing landowners out of their property. Fitting for the first Democrat and a worthy role model for Obama.

Most likely the vote was 5-4 to kill Obamacare. Should one of the 5 suffer a fatal "accident" or "heart attack" or "assassination by a right winger" before the final ruling, a new vote would be required. This would result in a 4-4 tie, thereby preserving Obamacare. Or the case might be reheard after a replacement is appointed by Obama and the Democrat Senate. This is why the House is not merely authorized but REQUIRED to impeach a criminal president like the one we have.

What good would that do? The HR can impeach the president all they want, but it is the Senate that tries, convicts, and removes from office. You need 67 votes in the Senate to remove someone from office. At present there are 47 Republicans. Please list by name the 20 Demonrat Senators that will vote to convict.

The law is what Obama says it is, not the court, not the congress.

The Justices voted last Friday so they have already made their decision and it is documented. Currently they are writing their memos on the reasons for their decision. They do have the option of changing their opinion up until June.
