Obama warns 'unelected' Supreme Court against striking down health law

His ignorance on the nature of the SC is astounding. But perhaps he is not ignorant, just banking on the fact that there is a portion of the electorate that KNOW NOTHING about our form of government.

Tactically, that has to be the dumbest move he could have made.

If anything, it is likely to blow up in his face because even the Liberal Justices are going to have to be worried about the independence of the Supreme Court and it’s position as a coequal branch of government.

Maybe 40 years ago a 7th grader could tell you what the Supreme Court is supposed to do but probably not today. Frankly, I doubt very many kids with a high school diploma could tell you.

Yes, MOST of the possible scenarios for the outcome of this are worse. I HOPE WE DO get The Battle of Athens, because I think that's probably the least bad of the quasi-civil-war scenarios. It's over and done with quick.

Of course Kag & Soto are probably so proud of him - backing them and trashing the Constitution at the same time. What courage, what strength!

I worry that all this unconstitutional action and rhetoric will end up casting the actual Constitution in a bad light when it prohibits the handouts that some people want.

As more and more laws in this country go unenforced and less and less constitutional adherence is applied to our governance, the less the “rule of law” will mean.

If the President can assume power of influence over the court (not that he has but seems to think so), if Black Panthers can put a bounty on a citizens head, if our government can force us to buy something or enter into and enforceable contract, the rule of law is dead or near to it. When civil cases start to be won using a defense case based on precedence set by our government, the law is dead.

Want Proof?

Explain to me what Illegal immigration really means anymore. It’s not apparently illegal to be here without permission, documentation, etc. It’s just illegal to get here? That is, we only enforce the law if you get caught getting here illegally. Otherwise you can vote, collect welfare, unemployment, etc. all without fear. Just don’t get caught anywhere in the US trying to get into the US.

When will some nutcase NeoNazi put a public bounty on the head of the Black Panthers? Will there then be a prosecution? They can’t now. They would have to arrest both that launched the bounties. Right?

I agree, my knee-jerk reaction was to judge his words as if a normal non-malevolent person had said them, plus it lowers my blood pressure to call him a moron. But he knows full well what he's doing, it fits the overall pattern.

Obama had hs minions go out and threaten SC. I have no doubt that obama was made aware of las Friday’s SC vote. Kagan was his solicitor general....a political appointment...she was on the phone to obama within 2 minutes after the meeting broke up.

IIRC, he didn’t have enough votes to get his power grab passed. He had to do a lot dirty deals to get enough elected representatives hold their noses and pass it.

I think he went a bit off the reservation with this one, though. Politico is reporting the story with a lot of quotes, except they didn't quote his "strong majority" statement. It's an interesting bit of editing:

"Overturning the law would be “an unprecedented, extraordinary step” since it was passed by a majority of members in the House and Senate,” he said. “I just remind conservative commentators that for years we’ve heard that the biggest problem is judicial activism or a lack of judicial restraint. That a group of people would somehow overturn a duly constituted and passed law. Well, this is a good example. And I’m pretty confident that this court will recognize that and not take that step.”

They knew the "strong" was false, so they conveniently edited that out so their favorite canddiate didn't look like he'd said something so stupid.

Mr. Obama, it is the “unelected group of people” that is charged with writing what is yet unwritten in this law that we fear far more than this particular group to whom you refer.

The Supremes are “unelected” for a reason. They are appointed for life terms because the founders felt that one of the branches of government needed to be free of having to campaign for votes, thereby retaining the ability to be impartial.

As a constitutional scholar, I’m sure you were aware of that...../sarc

An initial vote is not the final vote. Saying something like this could tweak one of them to change it because they want to be able to do their job without the executive branch threatening them and appearing to bow to its wishes and appear subordinate. Doesn’t matter if you’re liberal or not. They can’t set the precedent of appearing to be lesser than the executive branch, or be schooled by the executive branch on their exclusive branches’ power. Much less the executive branch’s blatant threat against them.

Of course Obama could also be doing this to guarantee they have to strike it down, in order to use it as a campaign issue for 2012.

Or, they are baiting us. Make a big stink, get us to defend the SC as honorable and right, then have them come out and say the law is constitutional.

I am going to hold my judgement until the decision is out. The courts will need us to defend them if they do the right thing. We will need to shun and turn our backs to them, if they do the wrong thing by supporting the monstrous Obamacare.

I know what he’s doing.

He wants Obamacare struck down.

He wants to run with this as a 2012 election issue.

Vote for me, I will make sure the court gets the right people on it.

There will be a lot of upcoming retirements. If he’s in the next 4 years, all the libs who retire get replaced with Sotofatasses or Boatload Kagans. All the conservatives who retire get replaced with Sotofatasses or Boatload Kagans.

Then the court will have no judicial activism because they will all be liberal and when liberals do judicial activism, it’s not judicial activism.

This is what is going on. Start getting prepared. We have to make sure our cnadidates pledge to nominate only strict constitutionalists to the SCOTUS and EVERY position underneath it. No moderates or liberals anywhere. We are already swimming in them and are suffering for it, some for decades now.

No, because Holder has already established the precedent of selective enforcement in regard to the Black Panthers at the polling site and has seemingly gotten away with it.

I am 100% sure that Elena Kagan leaked the results of the vote to Barry as soon as it was over.

This has been a long standing Dem tactic. Make an absurd claim, then push it as truth. You instantly make the other side go on the defensive. It also paints them as being "radical", possibly even Racist, for not not doing something "so many people" want.

It doesn't matter what the truth is, just the impact of the statement.

Even if someone makes a big deal of it, it's vague enough that the other side can then be painted as having their "tin foil wound too tight".

It also gives a narrative for the MSM to push out to the masses who don't know Robert's Rules of Order from a Chick-fil-a menu...

Hospitals that have emergency rooms cannot turn anyone away for emergency medical care. There are already laws for it. Wow she doesn’t know anything. I wonder if she really knows American law?
