Sacramento County DA locks up alleged sex assault victim

A 17-year-old Sacramento girl has been locked up for more than a week now for her failure to appear in court against a swastika-adorned defendant with a 20-year criminal history who is accused of three counts of raping and sexually assaulting her.

Sacramento County prosecutors sought the material-witness warrant on the alleged rape victim, and two Superior Court judges have since ordered her detained to ensure her presence as a witness in a trial scheduled to begin April 23.

The girl is being held in juvenile hall in lieu of $50,000 bail. . . .

She was not locked up for being a rape victim. She was locked up for failure to appear in court as a witness.

Since when has anyone been ‘compelled’ to testify either for or against another person?

I’d sure like to see that law.

So, that means if she gets on the witness stand and just keeps saying ‘I don’t remember’, she’s going to be thrown back in jail as a hostile witness?

The DA is a Fag.

They are victimizing this girl again and eroding her trust in humans all over again.

If she can’t bear all the feelings with seeing him again or the airing of her horrible violation then move on.

Let her be and find a way to convict the guy without her.

I thought that in this type of case the victim would swear out an affidavit. Wonder if she is Jewish. That would make the debacle complete.

The DA and Judge are going against the States own CODE OF CIVIL PROCEDURE... which makes it ILLEGAL to imprison a witness of rage..

“Locking up rape victims to force them to appear in court against their alleged attackers is so rare that one local DA’s official, who spoke on condition of anonymity because of the pending case, said he was aware of only one other case.

It also pits a Penal Code section that allows for warrants to ensure material witnesses “appear and testify” against the state's Code of Civil Procedure, which says you can't “imprison or otherwise confine” sexual assault victims who refuse to testify.”

Some of the comments on the site just make my blood boil.

Where has our ‘freedom’ gone?

It happens every day. Testify or go to jail for contempt of court. Refuse to testify before a Federal Grand jury and you sit in jail for contempt until the Grand Jury session ends (18 months IIRC) or until the case is resolved without your testimony. This can be repeated twice (36 months total jail time).

You can’t be forced to testify against yourself or your spouse. Anyone else and you have no choice.

I agree that the sophisticated thing to do is to allow "darwinism" to take its course.
