WASHINGTON - President Barack Obama is laying groundwork to make the Supreme Court a campaign issue this fall, taking a political page from Republicans who have long railed against the decisions of liberal judges.
The emerging Democrat strategy to paint the court as extreme was little noted in this week's hubbub over Obama's assertion that overturning his health care law would be "unprecedented."

It’s a good campaign move. Even if the court rules in favor of the mandate. The comments made by people thinking the court is going to overturn the law are enough to carry him through the election. If the court overturns the law then it takes the issue off the table for the election. Can’t run against the health care law anymore.
Since he has sworn to uphold the constitution, how can he run against it? Isn’t that an impeachable offense?

All this criticism of our Dear Leader is racist. He was a law professor so he obviously knows the law better than his critics. He is the smartest man to ever inhabit the White House according to presidential historian Beschloss. You can tell how smart he is by the crease in his pants. He is probably the smartest man in all of these 58 states.

What the Republicans and conservatives are complaining about is judge-made law, which is true judicial activism. That is, the court is not simply ruling on the constitutionality of a law and making a decision, right or wrong, about it, but imposing its own law in the form of “remedies” (such as busing, affirmative action quotas, etc.).
It is also true that liberal courts often invent things in the Constitution to justify their ideological positions (look at the “penumbras and emanations” in Roe v Wade). This is more difficult to challenge, because it is their right to be wrong, so to speak; but conservatives are right in demanding that the courts adhere more closely to the letter of the Constitution, and this does not constitute an attack on the judiciary.
The Dems, on the other hand, are encouraging the courts to look at non-American law, ranging from the constitutions of other countries to UN pronouncements, and imposing on the citizens of the US these decisions that are based on foreign law. This is judicial activism of the worst kind, because it is changing our legal system.
That’s not what Obama is objecting to, however; he’s objecting to the courts performing their fundamental, constitutionally specified duties to check and balance the actions of the legislature and executive based on their reading of the US Constitution.
Since Obamacare is even less popular than Obama, I think the Republicans might do well to encourage this strategy...
I have never seen Republicans campaign against the Supreme Court.
Talking about appointing non activist judges is not the same as openly insulting the Supreme Court.
