Climategate Heads to Court

As a climate scientist, I am quite familiar with the background facts that Prof Michael E. Mann (now at Penn State U) so shamelessly distorts in his new book The Hockey Stick and the Climate Wars: Dispatches from the Front Lines.

First, the scientific background:

Mann's claim to fame derives from his contentious (and now thoroughly discredited) "hockeystick" research papers (in Nature 1998 and Geophysical Research Letters 1999). His idiosyncratic analysis of proxy (non-thermometer) data from sources like tree rings, ice cores, ocean sediments, etc. did away with the well-documented Medieval Warm Period (MWP - 900-1200AD) and Little Ice Age (LIA - 1400-1800AD) -- documented by Prof. H.H. Lamb, the founding director of the Climate Research Unit of East Anglia U (CRU-EAU). Mann then asserted that the 20th century was the warmest in 1,000 years. His temperature graph, shaped like a hockeystick (on its side) immediately became the poster child of Al Gore and the IPCC, the U.N. science panel, to support their claim of anthropogenic global warming (AGW).

Two Canadian statisticians, Steven McIntyre and Ross McKitrick, soon found serious errors in Mann's analysis; they even showed that random data fed into Mann's algorithm would produce "hockeysticks." To add insult to injury, while the 2001 IPCC report used Mann's result to bolster its AGW claim, the most recent 2007 IPCC report no longer relies on it. Mann still defends it -- sort of -- and so do some of his uncritical supporters. We have had no word yet from Al Gore.

In his book, Mann distorts the e-mail record from the "Climategate" leak; those e-mails have not been altered or edited in any way. They document a conspiracy among a clique of British and U.S. climate scientists to control what goes into IPCC reports, and to keep contrary views...

That link goes to a chat post. I'm sorry, but one of my major peeves is when good essays about major political issues are posted as chat or a blog. What's wrong with News/Activism so it can hang in the editorial sidebar, or in this case extended or frontpage sidebars. It has news! UVa is going to court about the FOIA effect on those emails.

I read the article and I can’t figure out what the court case is about. Who’s the defendant and who’s the plaintiff?

Mann is the plaintiff, Tim Ball is the defendant. Seems that in pretrial discovery, Ball can ask to see emails bolstering his defense. The author believes that the emails will embarass Mann no end.

The ATI case began quietly in January 2011, with a FOIA request to UVa for e-mails to and from Mann and 39 people, involving five grant programs. Seven months later, UVa produced almost 1,800 e-mails, but said it was withholding another 12,000, which they argued were not public record, or were exempt under Virginia FOIA law 2.2-3705.4(4). The case is scheduled for argument on April 16 in Manassas (in Prince William County, Virginia), in suburban Washington, DC.

This is the case. There is also another one in Canada, apparently, involving Mann suing Tim Ball.

Rudder, I believe Lonesome in Massachussets and Rocky got it right. UVa is being challenged about FOIA jurisprudence, and Mann stepped in it by suing Tim Ball for defamation. He’ll be sworn under oath in pretrial discovery in the defamation suit. IMHO, he’ll drop the defamation suit, or Mister Hockey Stick will possibly risk perjury or obstruction of justice charges.

Thanks all. I think Mann will cave or otherwise not prevail in court.

What they (AGW) need is a static universe for their position to be true.

Which is exactly what global warming alarmist’s models predicted would happen- and, if there wasn’t record snowfalls in alaska, their models had predicted that exactly as well, infact, any which way the wind blows, it is to be expected because man has so fouled up the climate that apaprently we’ll never ever recover- (btw, man’s contribution of CO2 is only .03% of the total CO2 in atmosphere- it barely registers it’s such a small amount- but by golly, man is supposedly throwing the whole climate out of whack with htis miniscule amount? I think not)

I think it's more like 0.003%. Here's a chart showing just what "Greenhouse Gases" are as a portion of our atmosphere:

The largest GG that is totally ignored in all of these computational excesses is H2O that can give us feet of rain, snow, and ice -- all because of cold. We need it to stay warm!

There are 2 issues and that is what could be confoozing.

One is that ATI is suing U of VA for their refusal to release the 12,000 Mann emails, though they had released them to Mann which they (ATI) argues, nuliffies their (U of VA) argument under the exemption clause of FOI.

The other is Mann suing Tim Ball who is Candian and there is hope he will use the discovery process to discredit Mann.

The first time I looked at that, I too thought they'd screwed up. Until I saw that the 3.62% is of the 2% block of all the GG components and of that the Human portion is the 3.4%. So it's 3.4% of 3.62% of 2% - doesn't even reach the noise level in any other observations!

oh i see- Math waqs never my strong point lol- but it is very apaprent, that we could actually multiply our output of CO2 1000% and still only be contributing only 3% to the scant 2% of CO2 in the atmosphere (or thereabouts, if I didn’t mess up the math) So in essence, ALL businesses across hte glob could increase their output 1000% and stikll not even make a dent in the total amount in atmosphere-

Global warmign scientsist make it seem as htough our atmosphere is ‘full to hte brim with CO2 and that if ‘we don’t act onw, it will soon bwe too late’ but the fact is over 1000’s of years, man has had very very little impact on the total amount in atmosphere- not even 1%- they make it seem as htough the atmosphere can’t sustain hardly any more- and that it’s at a ‘breakign point’- as though the ‘glass were full to hte brim’ and addign any more will cause it to spill over

How they can get away wkith htese massive distortions is beyond me-
