Marco Rubio, the GOP and the DREAM Act

WASHINGTON -- A few weeks ago, Daniela Pelaez visited Washington. A valedictorian at North Miami Senior High, the 18-year-old had just learned she no longer faced deportation, thanks in part to congressional intervention in her immigration case. She visited the nation’s capital the same week a Fox News Latino poll found Hispanic voters favor President Barack Obama six-to-one over any of the Republican presidential hopefuls. Suddenly, there was new life in the DREAM Act, an immigration bill that offers a path toward citizenship for young people like Daniela who came to the U.S. illegally with their parents. Enter Florida Sen. Marco Rubio, who has cautioned his party on its stance on immigration, even as he’s considered one of the few Republicans who, with the No. 2 spot on the presidential ticket, could help draw Hispanics to the GOP. Rubio now is floating a Republican version of the DREAM Act. It’s still just a concept, but with the backing of the leading Hispanic Republican, it’s seen as a way for the GOP to appeal to Latino voters turned off by the party’s harsh rhetoric on immigration. Democrats have already panned it, and a New York Times editorial called it “the DREAM Act without the dream.” Rubio’s proposal allows young people who came to the United States with their parents to have access to a non-immigrant visa that allows them to study, and after their studies are complete, allows them to work legally in the United States. Eventually, Rubio said, they gain the same status of other non-immigrant visa-holders and are eligible to apply for residency. Three to five years after they obtain a green card, they’re eligible for citizenship. “It’s a non-immigrant visa, so it doesn’t put them on a path in and of itself to residency and then citizenship,”

So they could go to school or into the military? “Or start working when they graduate from school while they’re waiting in line for their green card. And it may take awhile. But that’s not a function of this bill, that’s a function of this broken immigration system, which I’ve long said needs to be modernized.”

In 10 years when the next wave of illegals have came here and they will be saying well the last group got the dream act and amnesty, if they can have it, why can't we have it ? Our circumstances are just the same as those say from 10 years ago. We had no say, we do good in school, why do they get dream act and we do not ? Then we shall hear it all over again how this broken immigration system, is once again broken.There is no one dream act. There is no oversight under projected dream act. Why would it be said only 2 years of military, if I went to sign up today, the very least would be 4 years, even this part of their dream act bill is not equal and with only 2 years, the illegals would get all the benefits the military offers to men and women of the arm forces who must serve at least 4 years to receive.

Rubio said they needed to be able to move forward with their lives.

They and their criminal parents who stole tens of thousands from American school systems can always buy a ticket home tomorrow morning. Then they're free to "move forward".

As much as I like Rubio, don’t forget that he is NOT natural born. Although he was born in the US, his parents were not naturalized citizens until after his birth.

Please explain this to Sean Hannity and Mark Davis and Mark Levin who for some reason think we should just ignore this glaring fact. I like Hannity but every time he starts talking about Rubio I want to scream. He has been told Rubio is not eligible but he just wants to ignore that part of our founding documents!

Why? Why? Why? What the heck is wrong with these people? Ignoring this requirement is THE REASON we are serious trouble now.

Hannity is an opportunist and a wuss. He plays the arch-conservative because he discovered how gullible people are and how much money he can make at it. He spouts the same talking points over and over, day after day, month after month. I don’t think he has had an original thought in years.

Mind letting us know where you learned that? It is at odds with the definition of 'natural born citizen' according to the Congressional Research Office:

In addition to historical and textual analysis, numerous holdings and references in federal (and state) cases for more than a century have clearly indicated that those born in the United States and subject to its jurisdiction (i.e., not born to foreign diplomats or occupying military forces), even to alien parents, are citizens “at birth” or “by birth,” and are “natural born,” as opposed to “naturalized,” U.S. citizens. There is no provision in the Constitution and no controlling American case law to support a contention that the citizenship of one’s parents governs the eligibility of a native born U.S. citizen to be President.

It just the same ol’ birther nonsense. I’ve heard arguments that Santorum, Romney, McCain, and Rubio aren’t qualified either.

Mark Levin thinks Rubio is good to go, and that’s good enough for me.

The Supreme Court clearly established who was a .....“natural born citizen” ......in the case Minor v. Happersett (1874).

Justice Gray thoroughly discussed the definition of “natural born citizen” in his review of the Minor case.

The Supreme Court in Minor adopted the..... Laws of Nations.... definition of “natural born citizen” as being a person born in the United States to .....“citizen parents”.......(Notice the “s” Parents!!) –”

this definition does “not” include Mr. Barack H. Obama, Jr., because his father was “not” a United States Citizen.

Minor Vs. Happersett 1874 has... NEVER... been over turned.....

Congress has attempted to over turn this about 7 times sine 2004..... But is has NEVER been overturned!!

Even some law schools no longer teach this..... They are wrong!!!!!!!!!

Many in the media refuse to address this ... I understand the Obama Administration threatened anyone who addressed his eligibility....Starting back in Nov or Dec 2008..... This does not make the problem go away!!

It just makes us want to stand up & “Demand” that our Constitution be “Respected”!!

I thought Romney was dead to us too, but we are being forced to vote for him. If Rubio runs someday, it will be the same. None of this will matter. People never pay for their beliefs anymore.

Thanks for the cite. I'm always leery of relying on quotes...that for some reason....include lots of ellipses...

Let's see what the text of the decision says: "The Constitution does not in words say who shall be natural-born citizens. Resort must be had elsewhere to ascertain that. At common law, with the nomenclature of which the framers of the Constitution were familiar, it was never doubted that all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives or natural-born citizens, as distinguished from aliens or foreigners. Some authorities go further and include as citizens children born within the jurisdiction without reference to the citizenship of their parents. As to this class there have been doubts, but never as to the first. For the purposes of this case, it is not necessary to solve these doubts."

Well, right off the bat they state this case isn't determining that question (and goes on to explain that is because it is satisfactorily known in reference to the plaintiff, a Missouri woman fighting for her right to vote). Somehow you left that critical part buried under ellipses...
