SANTORUM: Romney’s record of judicial capitulation

. . . . . What sort of justice to the Supreme Court will Mitt Romney nominate - a Souter or a Thomas? A Miers or an Alito? A Kennedy or a Scalia? His record as governor of Massachusetts gives no cause for optimism.

Mr. Romney nominated 36 judges while governor, just nine of whom were Republicans. What he says of this record today is that the Massachusetts Governor's Council had to confirm the nominees, and the members of the council were all Democrats. So his answer was to nominate persons palatable to Democrats.

But this all-Democratic Governor's Council is effectively no different from the U.S. Senate. Even if, as I expect, Republicans gain a majority of the Senate this year, so long as Democrats have at least 41 members, they will be able to block by filibuster the confirmation of any Supreme Court nominee (or other federal judicial nomination, for that matter) . . . . .

The Boston Globe slapped Mitt down for trying to connect Santorum to liberal judicial nominees by way of Arlen specter. After all, Mitty himself was nominating liberals left and right.

I was on Rick's site and they have scrubbed a lot of the negative articles about Mitt Romney.

Time is running out to get Willard on record on these issues. I’d like to hear him respond to this kind of information, so I’m glad someone is bringing it up.

I'm no fan of Romney, but he probably nominated all nine Massachusetts Republican lawyers to judicial posts.

If a President Romney gets to appoint a replacement for a conservative Justice or for Kennedy I expect he will appoint a programmatic leftist. That way he can make a lot of conservative noises as the President while the Court installs his preferred totalitarian government and he can rail at the Court if he feels he needs to while saying,”Sorry guys, it’s out of my hands. It’s not my fault.”
