The Tulsa County District Attorney's Office ruled Tuesday that the deadly force used by the Tulsa Police Department last month during a burglary was justified.
Officer James Comstock shot Phillip Steven Doll, 25, after Doll was found hovering over a 65-year-old woman in her home and refused to obey officers' commands to back away, police said.
"At the time (Comstock) used deadly force, he had a reasonable belief that that woman's life was in jeopardy," First Assistant District Attorney Doug Drummond said.
Doll was shot about 8:15 p.m. March 20 in the residence of Eva Dell Jones in the 900 block of East 36th Street, police said.
Officers said at the time that Doll was not armed, but Drummond said that after reviewing statements from officers and witnesses, Doll had his hand behind his back "like he had a weapon."
"The law clearly states that you're not to look at these at hindsight, and you have to look at these in their perspective going on at the time," Drummond said. "It's a tense situation. The officer has to make a split-second decision on the force to use."
Drummond said that considering all the factors and statements presented to the District Attorney's Office, the shooting was justified.
A man who identified himself as Jones' grandson called the police at 8:12 p.m. March 20 to report the burglary. He met officers outside the house when they arrived four minutes later, Officer Leland Ashley said.
On the 911 call recording, the grandson, who lived with Jones, can be heard telling a dispatcher that "there's somebody in there that's not supposed to be in there."
He said he could see his grandmother sitting in a living room chair but said she was not responding to his voice or answering three or four telephone calls he had made to her.
When officers arrived, they entered through the backdoor and heard Jones begging someone not to hurt her and saw Doll hovering over her, records show.
Doll was shot after he reportedly refused to obey officers' commands. He was pronounced dead at the scene.
Doll had been named by police earlier that day as a "person of interest" in the death of Natalie Anne Davis, 22, whose body was found about 11 a.m. that same day at her residence at the Lodge Apartments, 7901 S. Yale Ave. She had been shot, police said, and investigators think she might have been dead for days.
Police did not say Doll was a suspect in Davis' death but said they wanted to talk to him about his relationship with her.
Comstock, a nearly 20-year veteran of the Tulsa Police Department, was placed on routine administrative paid leave while police investigated the shooting, but he returned to duty Wednesday, police said.

Jesse was in Tulsa and Al is scheduled to show up. I just wish someone would ask them about those 2 elderly people who were attacked. But, they don’t count, of course, because they are white.
