Netflix subscribers decry $27M class action settlement

A handful of Netflix Inc. (Nasdaq: NFLX) subscribers have asked a federal appeals court to overturn a $27.2 million class-action settlement that they say unfairly gives plaintiffs' lawyers over $8 million in fees for bringing suit over the marketing agreement the movie service company entered into with Wal-Mart Stores Inc. (NYSE: WMT).

Lawyers are scum.

I once settled a wrongful termination case, they let me go because I was in the military and actually put it in writing. The legal fees were paid by the defendant but he “forgot” to charge them a few hundred so he took it out of my paltry settlement.

I literally did all the work.

Did I mention that lawyers are scum?

I was part of a Sears class action suit, by the time it was over, I received a coupon for 25 dollars off of my next purchase. The lawyers got millions.
Never again.

Do class-action lawsuits ever turn out otherwise? Are these plaintiffs that naive?

Perhaps they could file a class-action lawsuit against the lawyers.

Netflix is worth it just to watch the “Lost” series in its entirety. It’s fabulous. The best TV series I’ve ever seen. It’s the Russian novel of TV shows. I want to encourage shows like this.

I was once part of a class action suit against MBNA. Don't remember what it was for...I was back in college. When it was over...I got a check for $.67. 67 cents.

Again...the lawyers received MILLIONS and MBNA recouped their costs by raising my fees. ;-)

All class action suits should require participants to explicitly ‘opt-in’ rather than ‘opt-ou’t. No one, much less a complete stranger, should be allowed to take legal action on my behalf without my consent.

About a dozen years ago, I was notified that I was a member of the class in a lawsuit against manufacturers of computer monitors. Apparently, some discovered that if you buy 15 inch monitor, a few millimeters of the screen around the outside was black so the actual diaganol measurement of the illuminated viewing are was slightly less than 15 inches. This, declared the plaintiff’s lawyers was ‘consumer fraud’, despite the fact that all the major manufacturers followed the same covention and all the people who bought the monitors could see exactly what they were getting from a display model.

This was an obvious enough scam that I took the time to find the address of the clerk of the federal court in fine print, type and print a letter asking to exclude me from the suit, then mail. Nonetheless, about 6 months later I received notice that a settlement had been reached and I got a coupon good for a 15 dollar mail-in rebate on my next monitor purchase from selected manufacturers. The lawyers received a settlement of about 7 million dollars.

The real fraudsters who belong in jail were the lawyers who perpetrated this nonsense and the judges who allowed it.

That was about 20 years ago, right? Sears automotive? I was working at Sears auto at the time. I remember that well. It cost me my part-time college job. Sears was giving away vouchers to anyone and everyone who claimed they had their car serviced at Sears. No proof necessary, just some paperwork. It was a free-for-all.

Surprised the company survived.

Do the lawyer-bashers think that class action lawsuits should not exist? Or do you think that teams of lawyers that work for years in this specialty should be unpaid?

Do y’all realize that there is competition (”too many lawyers out there!”, right?) And competition means that law firms can undercut on compensation if the lawyers who win are really overcharging.

There is a place in the legal system for the concept, but as it currently exists, and abused by the legal profession, no. Like a previous poster commented, it is obscene that someone can bring a case into court in my name without my permission. You should have to request to be a member of a 'class'.

They should be paid a hell of a lot less than they are now, for what are often lawsuits of questionable value. If they actually had to identify individual members of the 'class' and get their consent, it might be worthwhile.
