California Assembly OKs measure to ban carrying unloaded rifles in public

Carrying unloaded rifles in public would be prohibited under hotly contested legislation that passed the Assembly on Thursday.

Assembly Bill 1527 cleared the lower house, 44-28, with no Republican support.

Proposed by Assemblyman Anthony Portantino, D-La Cañada Flintridge, the bill stems from the "open carry" movement in which gun-brandishing people protest against gun-control laws.

The movement sparked headlines in 2009 for a rally outside an Arizona convention center where President Barack Obama was speaking.

California cracked down on carrying unloaded handguns with a new law that took effect Jan. 1. Portantino's bill would expand that prohibition by targeting rifles.

"Sooner or later, somebody's going to get hurt," Portantino said of open carry. "If you see somebody walking around a mall or main street with a shotgun, it's pretty intimidating. It's unnecessary, and it is just going to lead to trouble."

Opponents counter that AB 1527 would create a new obstacle to the constitutional right to bear arms and would do nothing to reduce violence because criminals do not honor such laws.

Members of the open carry movement are "law-abiding citizens who have no evil, nefarious purpose," said Republican Assemblyman Jim Nielsen of Gerber.

Assemblywoman Norma Torres, D-Pomona, asked colleagues to imagine themselves inside a restaurant when a gun-wielding person walked in. "How would you feel, not knowing the mental state of that person?" she asked. "I would be afraid."

Assemblyman Ben Hueso, D-San Diego, said he considers AB 1527 a pro-business bill because communities must be "free from intimidation" if the state hopes to boost tourism.

The bill allows dozens of exceptions, including carrying a rifle on private property with permission of the owner, carrying it in a gun show, or carrying it for use at a target-shooting range, a parade or while hunting.

Notice that this has nothing to do with crime or harming people, and everything to delegitimize the carrying of weapons by citizens. It creates the tyrannical state of "everything that is not allowed is prohibited".

It is utterly, completely, unconstitutional. Those who voted for it should be impeached.

It is hard to believe that even the California legislature would sink this low.

California will be experiencing the “Curley Effect” on a state-wide basis. Like Massachusetts has.

It will become a gulag.

These people are afraid of their own shadow. How about gun racks in pick-ups? Are they afraid of them also?

No it's not hard to believe, it's California. Good grief, the state is a leftist cesspool. CA is a basket case and things are only going to get far worse. Any conservative with the means to leave should have already done so or be planning to. Besides, we could really use conservative refugees from California in some of the purple states that are sliding toward the dark side. VA, NC, CO, etc, need more conservatives to bolster the ranks of the productive, thinking people.

Easy enough for me to believe it. I wonder if carrying said unloaded rifle in a gun case is allowed...I also have issue with most of the CCW laws that insist that your concealed weapon never be able to be seen by another citizen. More open carry folks would go a long way in reminding the bad guys that there are weapons available to put a crimp in their "style".

What is sad is that the average Californian you would meet on the street has no idea that this law just passed, nor would they care if you informed them. In fact they would think anyone who worried about such things to be a little off balance themselves

Doing some biased profiling there Norma Torres? But, realizing the percentage of whacko human debris in California relative to normal mainstream America, maybe she would worry about “mental state” of people there.

Next I suppose they’ll ban the carrying of empty rifle cases because people wouldn’t know if there was or was not a rifle in it. Or, any bag or case that had a gun logo on it. Might cause panic with the sheep that live there.

Citizens with no criminal record should be able, at will, to carry, concealed or open, any firearm they please, hand gun or long gun, anywhere they please without let or hindrance by government authorities.

But wouldn’t you feel better if you or your companion had a loaded 45 ready for trouble?

I think they miss the point about open carry. They could have their own gun for self defense.

They don’t think it is there responsibility to protect themselves, that’s somebody else’s job.

What a stupid statement. So you know, for a fact, that there are more “wackos” here in California than in “mainstream America.” We have ten percent of the population of the country, so just on that basis alone we are quite likely to have more “wackos” than where ever it is that you live. Most Hispanics are not wackos, but the illegal ones are a problem. But then, you are happy to eat the stuff that they pick. And we still, despite the best efforts of our Legislature, have the largest economy in the country by far; bigger than some well known European countries. Finally, I don’t have to live in a double wide to be able to live with less “wackos,” so at the end of the day my life is still far better than yours.
While you are deprecating this beautiful state, you had also be thinking about whether or not we will be successful in reining in our $hithole government, because you are next, and you are well on your way to being us as this is written.

David victor Hanson wrote a piece about two Californias. The liberals in this state write laws to affect the law abiding taxpaying citizen. The other half of the state broke the laws to get here and really don't care about any laws. The jails in the state are full and they turn out hardened criminal out on the street to commit more crime. There is some much property crime and copper theft that it plagues the farmer in the San Joaquin valley. The police have been instructed not to impound the cars of illegal that have no license or insurance. California is now a third world country and getting worse everyday.

And next time READ what I wrote and quote me correctly. I said: “realizing the PERCENTAGE of whacko human debris in California relative to normal mainstream America” while you conveniently misquoted me with “that there are more “wackos” here in California than in “mainstream America.”

I have been there many times and viewed the whacko human debris on the streets, watched California’s loony government that gets thanked at every election, I have seen a lifetime of that state’s wacko entertainers in action, I see the California enviro-wackos that outshine every other state in lunacy, watched that state’s love of dope, see the news from that place, and more.

And your statement: “Finally, I don’t have to live in a double wide to be able to live with less “wackos,” so at the end of the day my life is still far better than yours.” is about as, as you say “a stupid statement” as could be made.

I understood what you said completely. I just wonder at the stupidity of folks like you who bash California. On it’s worst day, it’s light years better than any place on earth. Everybody is “in love with Texas.” I’ve worked in Texas and would not live there on a bet. I’ve worked in Memphis, beautiful place, nice people, but they have terrible weather for my taste and a far worse government that the place where I live in California. You “state class warfare Idiots,” who come to FR to give us your “assessment” of California had better take a look around at where you live. All the same crapola is there too. So instead of belittling our current situation, you might try something positive.

PS We got our “whacko human debris” from the East Coast, along with a large percentage of our legislators (other than the ones’ from Mexico). The queen of evil, Nancy Pelosi is from Baltimore, MD where her father was mayor before he went to jail!
