INDIANAPOLIS (WISH) - Richard Mourdock's Senate campaign is now the subject of a complaint filed with the Federal Election Commission.

It has to do with the accusation that the Mourdock campaign improperly downloaded information from a GOP database. The state Republican Party last week cut off the campaign's access to the database known as Salesforce.

The complaint was filed by John McCane, a former mayor of Rushville, who alleges that Mourdock used a state campaign committee to pay the $125 fee to access Salesforce and then illegally transferred information including email addresses to his federal campaign.

I know this is after the primary, but I saw the name and I had to laugh. There's two of these clowns in the GOP-E. One in Arizona, and there's another one in Indiana. And both supported Lugar.

Mourdock Likely Violated Federal Election Law

State Treasurer's alleged "pillaging" of Indiana GOP database raises serious legal questions

 

INDIANAPOLIS (April 22, 2012) - Indiana State Treasurer Richard Mourdock likely violated federal election law by using state campaign funds for his federal U.S. Senate campaign, according to a legal analysis conducted for the Lugar campaign.

 

Last week, the Associated Press  reported Mourdock campaign manager Jim Holden had ordered his staff in an email to "start pillaging" a proprietary Republican Party database "like a Viking raider attacking a monestary (sic) full of unarmed monks."  Further research now suggests the incident likely involved a violation of federal election law.

 

Probe Exposes Evidence of Illegal Misuse of Campaign Resources

 

Media coverage of Mourdock's "Viking-gate" scandal this weekend raised legal questions as to the timing of Mourdock's planned attempts to "pillage" valuable voter, volunteer and donor information. 

 

Reviews of Mourdock's campaign reports clearly indicate only his state treasurer's campaign paid for one month of access to the party's proprietary computer database in January 2011 - not Mourdock's U.S. Senate committee.  The evidence indicates the Mourdock campaign then used the information from the database to communicate with Hoosiers at the time of his U.S. Senate bid announcement in February 2011 and has continued using the data for his Senate campaign.

 

In order to preserve the integrity of election process, federal law specifically prohibits "transfers of funds or assets from a candidate's campaign committee or account for a nonfederal election to his or her principal campaign committee or other authorized committee for a federal election."

 

Complaint Seeks Federal Investigation, Punishment of Mourdock

 

"Recent reports suggest that Richard Mourdock accessed voter information through his state committee, transferred the information to his federal committee and then used the information to send mass communications to voters through his federal committee," reads a complaint sent to the Federal Election Commission (FEC) today by former Rushville, Ind. mayor and former Rush County Republican Chairman John McCane.  "I respectfully request the Commission conduct further investigation into the actions of the Mourdock federal committee to determine whether a violation of the Act has occurred."

 

In his complaint, McCane confirmed that he received communications from Mourdock's federal campaign in early 2011 despite never having provided Mourdock with his contact information.  He notes, however, that as a former Republican elected official, his information was likely stored in the State Party's database.

Mourdock running as an indy, or what? It sounds crazy for the state GOP to just turn an icy back to him if he really did out-primary Lugar.

As for this, well is all fair in love, war, and politics? I don’t even have any way to guess about the legalities, as the GOP may have promised Mourdock something they can’t just welsh on arbitrarily. I’m not thrilled with the idea of giving carte blanche to politicians to reap other politicians’ email lists, but in this case it seems so counterproductive not to let Mourdock use Lugar’s contacts.

Well, keep in mind that this is a late posting.(about 3 weeks) This was before the primary happened.

If the state GOP in Indiana is loaded with GOP-E(which it appears that it may be the case), then it would make sense that they would turn their back on Mourdock. Before or after any election, the general election, whatever.

One can never be too sure when it comes to establishment types, other than they are not with us.
