OTTAWA Another chapter in the internationally watched case of a white South African, who has been seeking refugee status here based on his race, came to an end Thursday when the Supreme Court of Canada announced it would not hear his appeal.
But Brandon Carl Huntley still has a shot at staying in the country, pending another possible review from the immigration board.
Huntley has said he fears discrimination, harassment and possible death if he goes back to his native country. He said he has been attacked and stabbed a number of times by a black South African who used racial slurs.
After coming to Canada on a work permit in 2004, Huntley applied for refugee status in 2008.
The Immigration and Refugee Board found him to be a refugee, based on a "well-founded fear of persecution on the ground of his race."
In his written decision, tribunal chair William Davis said Huntley "would stand out like a 'sore thumb' due to his colour, in any part of the country."
Davis also said evidence presented in the case showed a "picture of indifference or inability or unwillingness of the (South African) government and the security forces to protect white South Africans from persecution by African South Africans."
In a 2009 statement, the ruling African National Congress said the decision was "sensational and alarming" and that it would "only serve to perpetuate racism."
Abraham Sokhaya Nkomo, South Africa's high commissioner to Canada at the time, called the decision "outrageous" and said it could damage relations between the two countries.

Wouldn’t ALL South Africans be “African”?
And, pardon me asking, whites expected what?
If a White S. African person moves to the United States and becomes a citizen, wouldnt that make them an “African American”?
Just shows why that term is not accurate...
