California Supreme Court to decide if illegal immigrant can practice law

The California Supreme Court agreed Wednesday to consider whether the State Bar has the authority to license an undocumented immigrant and allow him to become a practicing lawyer.

In their weekly closed-door conference, the justices unanimously decided to consider the case of Sergio Garcia, an undocumented immigrant from Mexico who graduated from Chico State University

The State Bar approved him. The State Supreme Court, to its credit, did not rubber-stamp the Bar, and asked the federal government for its view before it decides the case.

For what it's worth, the would-be lawyer came here at 17 months of age and has been on a waiting list for a green card for 10 years.

I’m waiting for illegals to start running for office.

One of the basic rights isn’t it?

If such an individual is successful they’ll most likely be from a big blue liberal area - which means that suddenly liberals will become some of the BIGGEST border hawks you’ve ever seen.

who needs a court when bureaucrats, cops and politicians can decide which laws they feel like enforcing and which ones they can ignore?

If he can’t legally work here how can he practice law no matter his qualifications? Also, a lawyer is an officer of the court and as such his illegal status should disqualify him. Also, if he loses a case, would that not be the basis of an appeal?

It’s been done. In the 70’s, a San Francisco attorney, William Holguin, was a member of the state bar and practiced immigration law for years before being outed and arrested. He got a slap on the wrist and returned to practice. He couldn’t possibly be the only one.

A ruling will only make legal what’s been in place for decades.

Well, foreign citizens CAN practice law in California courts,

If this guy has a residential address in his country of citizenship, a ABA qualified law degree (he is if a Chico State Law alum), and no criminal record, he should just have to pay the ($166 or so) fee and fill out an application and sit in a meeting to get vetted.

So is this guy trying to gain in-state member status ?

I have no doubt he will be allowed. The only thing more Anti-American than the folks in Cal is the legal and political Leftists on the “Long March” through our country’s institutions. They mean to bury us.
