Drop George Zimmerman’s murder charge
nydailynews.com ^ | 18 May, 2012 | Alan Dershowitz

Posted on 05/21/2012 6:33:36 AM PDT by marktwain

A medical report by George Zimmerman’s doctor has disclosed that Zimmerman had a fractured nose, two black eyes, two lacerations on the back of his head and a back injury on the day after the fatal shooting. If this evidence turns out to be valid, the prosecutor will have no choice but to drop the second-degree murder charge against Zimmerman — if she wants to act ethically, lawfully and professionally.

There is, of course, no assurance that the special prosecutor handling the case, State Attorney Angela Corey, will do the right thing. Because until now, her actions have been anything but ethical, lawful and professional.

She was aware when she submitted an affidavit that it did not contain the truth, the whole truth and nothing but the truth. She deliberately withheld evidence that supported Zimmerman’s claim of self-defense. The New York Times has reported that the police had “a full face picture” of Zimmerman, before paramedics treated him, that showed “a bloodied nose.” The prosecutor also had photographic evidence of bruises to the back of his head.

But none of this was included in any affidavit.

Now there is much more extensive medical evidence that would tend to support Zimmerman’s version of events. This version, if true, would establish self-defense even if Zimmerman had improperly followed, harassed and provoked Martin.

A defendant, under Florida law, loses his “stand your ground” defense if he provoked the encounter — but he retains traditional self-defense if he reasonably believed his life was in danger and his only recourse was to employ deadly force.

Thus, if Zimmerman verbally provoked Martin, but Martin then got on top of Zimmerman and banged his head into the ground, broke his nose, bloodied his eyes and persisted in attacking Zimmerman — and if Zimmerman couldn’t protect himself from further attack except by shooting Martin — he would have the right to do that. (The prosecution has already admitted that it has no evidence that Zimmerman started the actual fight.)

The case is really falling apart when you have Alan Dershowitz saying that the charges should be dropped.

Alan Dershowitz believes in a lot of things most of us don’t, POLITICALLY, but he does believe in the Rule of Law.

Even the liberal Daily News admits this.

This is just a political lynching to appease the Al Shapton led crazed mob.

If the charges are dropped I wonder if the state will be responsible for the defense attorney's fees?

Seems like someone other than Zimmerman ought to be picking up that tab.

Howabout the scum-sucking, consciousless prosecutor?

The evidence is all pointing to what I suspected all along, that the case was obviously self-defense. Obviously, any time someone claim self defense in the death of another there will be an investigation - the cops aren’t going to just take some guy’s word for it. However, even in cases without any witnesses there’s usually powerful physical evidence that will either corroborate or discredit the suspect’s story.

The fact that weeks passed without any charges being filed indicates that the facts in the case were abundantly clear - of course that was before Jackson et al decided to politicize the issue. The detail’s of what happened between Zimmerman and Martin really isn’t a national issue; my only hope is that Zimmerman doesn’t get unjustly punished just to appease some aging racemongers’ demand for vengeance.

The lesson here is clear: don’t assault somebody, and you won’t get shot.

It’s too late to drop the charges. The let’s-grab-a- big-screen TV for Trayvon mobs are primed.

I don’t think the mob scene will happen in that area. Florida has a ton of armed citizens. Something on the order of 1 in 7.

You may be right but do you think the police will allow the citizens to defend themselves, their property, and their businesses? It's likely the police will issue a declaration to the effect that it's a police matter and to stay in their homes. The exception may be Sanford, FL which has a tiny police force. I'm thinking Miami, Jacksonville, etc. And who knows how many cities outside of FL.

Funny how the Trayvon story has mostly dried up in the media, now that Zimmerman’s injuries have come to light.

Oh, Self Defense was it? Nothing to see here anymore. Move on.

They need to drop the charges, then the fed needs to put Zimmerman in a relocation program. He will never be safe at home.

Interesting that the NY Daily News would publish this article by Dershowitz. It’s a liberal-leaning newsrag that caters to the “black/liberal/Jewish” market.

Perhaps this piece is but one more in the “cover our butts and back away” strategy that many “mainstream” newspapers seem to be adopting in response to the growing body of evidence in Zimmerman’s favor...

I agree. Maybe a curfew and extra patrols. I hope the kids act sensibly after the verdict is announced. No use stopping a bullet for some one who is already dead.

“It’s too late to drop the charges”

Actually, no it isn't. I read that there will be a hearing with the judge and at that time the judge can dismiss it right there. He should, since the evidence is overwhelming for the defense and non existent on the prosecution side.

Someone else was talking about the jury. It is my understanding that the defense can choose a trial without a jury, decided only by a judge.

Angela Corey should be charged with abuse of power and malfeasance in office.

She should do time, and she should be sued by Zimmerman.

Good riddance, Trayvon Martin.
