Ah, but in our legal system, the prosecution must by law give the defense whatever it has. In our system one is innocent until proven guilty, and the burden of proving guilt is on the prosecution (i.e., the State), and that’s the way it should be.

Ok despite all the hysterics here (and I generally support Z), it was quite clear at the bail hearing that the prosecution planned to rely on iconsistencies in Z’s statements.

Also, sealing the records appears to be supported by both sides. The evidence is not withheld from the defense.

The only possibly outrageous thing I saw here is referring to these statements as a “confession”. Had Z truly confessed to anything he would have been charged long ago.

Z certainly did not “murder” TM. However, he is in jeopardy on a lesser charge. One could question his decision to shoot when he did. That would be based on a claim he instigated the fight (I doubt he did) followed by whether he reasonably thought his life was in danger. That one is a closer call.

A 17 year old kid's hands are plenty to bludgeon and strangle another man to death. Considering Trayvon did indeed hit and pound his head against pavement, I say the law is backwards if it doesn't allow use of deadly force. Much to big of a burden someone being attacked

The one thing that struck me about Zimmerman’s account, even when I was in the anti-Zimmerman camp, was its consistency with himself, with the other witnesses, with the physical evidence - the only inconsistency was that he got out of the car to look at a street sign, but nothing else, and one inconsistency is understandable, for a human being under stress.

While the Zimmerman/Martin ‘white’ on black killing is covered 24/7 on the MSM with an outpouring of rage and charges of a racial hate crime, where is the concern- where is the rage about the home invasion, torture, beating, rape and murder of the elderly white couple by a gang of feral blacks in Oklahoma just a few weeks ago?

The 90 year old war veteran husband was beaten and his jaw broken. He was shot in the face numerous times with a BB gun and sent to the hospital in critical condition.

The 85 year old partially blind wife was RAPED and then BEATEN TO DEATH.

Can you just imagine the pain, the humiliation, the horror that dear old lady experienced being gang raped by that pack of feral animals?

(the autopsy states she was raped. Don’t think all of these animals didn’t all participate)

And can you imagine the pain, the horror of that dear old husband having to witness this?

Mr. Strait died from his injuries last week.

There’s a lot more involved here than a home invasion and robbery.

WHERE ARE THE CHARGES OF A RACIAL HATE CRIME??

90 year old husband’s jaw broken and shot in face with a BB gun numerous times?

85 wife year old semi blind wife RAPED and BEATEN to death??

Why does it take a foreign press to enlighten America as to this henious crime?

The MSM is soon to pick up on this concurrent case Corey has going...very telling that she's trying to force a plea from a "white Hispanic" 12-year-old that she charged as an adult.

Cristian Fernandez case

Sounds to me like a simple ploy to try and insure that a trial is held. The prosecutors know they will lose, and they want to make sure that a civil case will go forward.

People cannot grasp the concept: ZIMMERMAN IS GOING DOWN! Testimony will be produced to counter any evidence favorable to Zimmerman; physical evidence will be produced to counter any such evidence favorable to Zimmerman; etc., etc.,

I'm not so sure about that. Yes, I agree that "new" evidence will be declared to be produced, but so far even the prosecutor's compelling evidence produced so far is nothing more than hearsay & opinions. If the only evidence the prosecutor can introduce is inflammatory hearsay evidence, she cannot build a case on opinion & hearsay. All the evidence (Zimmerman's beating, the photos, the 911 transcript) validates & corraborates Zimmerman's account of what happened, including the only eye witness who saw Martin on top of Zimmerman, beating him.

If this trial did not have the black race baiting threats & violence, this would have already been thrown out. As it is, the judge in the case is a panty waist as well, because he should have the guts to declare the prosecution's case is invalid and so weak as to be thrown out immediately.

That little POS got exactly what he deserved considering the known facts.

If what we know is the truth, then Zimmerman simply proved that yes, this is a great country, you can defend your life without fear of being prosecuted by your own government, or wrongly sued for using lethal force to stop a thug from possibly maiming or killing you.

That point was debated on one of the threads. I'm pretty sure Z said he was looking for an address, not a street sign. I don't have a link handy, but there is a recording of it.

The "incriminating evidence" is likely GZ's name and the time of day. That's the standard that the prosecutor used so far, why to expect anything else?

GZ is being tried in media so that the obvious railroading during the trial will not be as noticeable. I fear he is being prepared as a blood sacrifice. His survival time in a prison, among an unfavorable demographic, would be measured in hours.

Good point! Probably Zimmerman’s lawyer wants all the evidence produced by the prosecutor, so that if a motion to dismiss is made, at least it will be obvious (to sane people, not the race-baiters or lefties) that this case had nothing to stand on.

Does the judge get to see this evidence at the pretrial hearing when Z has a chance to get the case dismissed, or does the prosecution merely have to state that they have compelling evidence that won’t be released until the trail?

Tgis is funny. The prosecutors don’t want the jury pool in the county where the [alleged] crime was committed to be biased by the media, and they want a fair trial. There would have been no special prosecutor and there would have been no charges and there would be no trial without massive Sharpton and other race pimp-generated publicity. Now they want it all tamped down? ha!

I suspect it will be a bunch of little inconsistencies, like they hinted at with the claim that Trayvon tried to smother him which they don’t believe. Unless they have something major I think someone in his situation could be forgiven for minor discrepancies. He was not exactly taking notes while this went down.

The lead detective stated publicly to the Orlando Sentinel that he did NOT recommend ANY charge against Zimmerman.

Either the Wagist.com or ConservativeTreeHouse.com published an Orlando Sentinel interview with Serino, and he says he did NOT recommend ANY charge against Zimmerman.

Dershowitz did not say he is innocent. He is saying the evidence presented by the prosecutor is not consistent with murder. He further says the evidence appears to fit the self defense story that Zimmerman has presented.

As a footnote, no one but Zimmerman knows the details of what took place.

This motion doesn't say when Zimmerman made these "contradictory" statements. It could have been after Corey's office took the case over.

Do we know for a fact that Zimmerman talked with Corey's office? I thought he offered to talk with them but it never happened.

If that's the case, then the lead detective lied to the Orlando Sentinel. According to page 28 of this link, the police concluded that:

"Based on the facts and circumstances outlined in this narrative, I believe there exists probable cause for issuance of a capias [e.g., arrest warrant] charging George Michael Zimmerman with Manslaughter . . . This case is being forwarded to the Office of the State's Attorney as a request for capias."

But also note the prosecution’s attempt to close the suppression hearings from public view. Anytime there’s a motion to close a hearing, save juvenile issues involved, I get suspicious.

Yes, you are correct.

The probable cause statement is on Page 44, by the way.

Here's the quote that confused me, and others:

“Investigator Chris Serino of Sanford police said Friday the agency has worked closely with prosecutors, and have not arrested Zimmerman because prosecutors have consistently told them they do not have enough evidence to win a manslaughter conviction.”

Sadly, I think you’re spot on. His “guilt” has been decreed by Obama, Holder and the media. They will make it happen regardless of anything resembling the truth.

It’s past the point where the DA, the “Justice” Department or the MSM is even trying to pretend to be fair anymore. The Party has declared his guilt, therefore he is guilty. Cased closed. Move along. No questions will be tolerated.
